<br /> The minutes of the regular meeting August 12th were read and were approved.

<br /> The following communication was read from the 0ity Manager:

<br /> On motion, the communication was ordered to be filed.

<br />The following communication/which had been placed on fi=st reading August l~th, was
<br />taken u~ and read: "In accordance witl~ ordinance which provides for re~ur.n of p, ermit fees
<br />for street repairs, I respectfully request that you credit the stem of $1,~91.96~ collections
<br />made for the first --six months of this yea~, to account 310 A-5, Labor for Maintenance of
<br />Sidewalks."
<br />
<br /> On motion of ~lr. Naupin, a special appropriation of $1491.96 was allowed for Labor,
<br />Maintenance of Sidewalks, and by the following vote:
<br />
<br /> Ayes-- Brooks, Dunford, Ma~mpin, Oast, Stewart, Ogg, 6.

<br /> The daily financial report of the Accounting Department for the day ended August 25, 1~30,
<br /> was received and was ordered to be filed.

<br /> This day came Robert B. Albertson and filed a petition alleging that he is aggrieved
<br />by an assessment of a building upon land owned by him, in the Oity of Portsmouth, for the
<br />yea,rs 1926 to 193O, both inclusive, by reason of the fact that the said building was des-
<br />troyed by fire on the 14th d~y of September. 1~25, and nothwithstanding has been assessed
<br />for the subsequent yea~s at a valuation of $400.00. The said land upon which the said
<br />building was erected being bounded and described as follows~
<br />
<br /> That certain parcel of land, bounded as follows: Beginning at the Northwest intersection
<br />of the Shell Road (Ohestnut Street) and Lincoln Street, formerly Nelson Street; ru~nlng thence
<br />West en Lincoln street, Forty-nine (49) feet to Whitehead's line, thence North alon~ White-
<br />bead,s line North Two (2) deggees Twenty-three (23) minutes East Four Hundred and Eighty-four
<br />(4~) feet to aniron~pipe; ~^$nce East~orty-one ~nd Four-tenths (41.~) feet to an iron p~pe~'
<br />in t~e West tine of the maid~Bhell Road, and thence South along the West side of the Shell
<br />Road, Fou~ Hundred and E~ghty-four (48~) feet to the point of beginning. The said land is
<br />shown on th~ Map of Brighton and a plat of record in the Clerk's Office of the Oircuit Oourt
<br />of Norfolk Oounty, in Map Book 3, page 32.

<br /> -Which said petition was defended by R. O. Barclay, who was appointed by the court as
<br />acting Oommonwealth~s Attorney, by reason of the said Robert B. Albertson, 0ommonwealth,s
<br />Attorney for the 0ity of Portsmouth, who was the said petitioner, having a private interest,
<br />as plaintiff, in the said petition, and upon the hearing of which proceedings John O. Niemeye~
<br />Oomm,ismioh~'2 of the Revenue of the Oity of Portsmouth, was p~esent and was examined affecting
<br />the said matter.

<br /> Whereupon, evidence being heard, and the court being of the opinion that the said Robert
<br />B. Albertson is the owner of the above described real estate, and it being shown to the court
<br />that the said building was in fact destroyed by fire on the 14th day of September, 1~25, it is
<br />adjudged, ordered and. decreed that the following assessments on the land books for the years
<br />1926 to 1930, both inclusive, the respective years, the line and page of the land book, where
<br />listed, the names of the successive owners, and the valuation of the land and buildings being
<br />set forth as follows:
