<br /> Since the receipt ef that letter we have spent a g~eat deal cf time and thought
<br />investigating the ~roposition-f=om every angle, Lncludingmauy interviews with the U. S.
<br />Engineering Department and with dredging companies.
<br /> While we have every desire to co-operate with the Gity of Portsmouth and to com-
<br />ply as fa~ as possible with yo~ wishes, we find that the question of costs makes the plans
<br />set out in said report impracticable;~
<br /> We can not ~dertake te have a~y dredging done t~h~a~t is indicated on the~map m~de
<br />by the U. S. Engineer, (el which.you have copy,) entitled "Norfolk N~=bor, Va. Scoffs ~G=eek.
<br />Survey cf December 1930", accordmng to which map the d~edging in what we m~y call the east-
<br />e~ b~anch of ~cotts Greek steps some distance Wes~ of your present bridge which crosses
<br />same nea~. the Northern end of Elm Avenue; nor can we agree to anyrest=icted use by o~-
<br />selves and co-ope=atlng interests cf the channel so far as ssme ma~ be d~dg~d~.except that
<br />we recognize, as a matter ef~ course, that we muSt operate within our legal rign~s;~
<br /> The report of your committee sets forth in part:

<br /> "The portion cf a~ea E east of where t~e A.G.L. Railroad
<br /> crosses the creek, will take only about 16,000 cu. yds. of fill, but
<br /> can be utilized without any cost for permanent improvements at pres-
<br /> ent; The Oity would benefit ~o the extent of increased valuation on
<br /> about lOO, O00 sGuare feet of property which would be partially filled."

<br />sum ef money is paid us towards the cost of same, the City of Portsmouth, being in agreement

<br />same te such height as may be approvtd by the Omty, not to exceed such heig~t-as maybe safe
<br />and practicable, using the present fill on which the $tlantic Go,st Line Railroad passes the
<br />Oreck as the retaining dike or darn.. Of course, after the d~edged ms. terial is ~ischa~ged
<br />upon the said area, it will settle and neither we nor She dredging company are to be expect-
<br />ed tc go 'back and again discharge material upon the area~ nor to guarantee maintenance of
<br />the height. This proposition is further base~, as a condition precedent, upon the city per-
<br />mitting the fill to be placed on area after the requestof the property owners of the area
<br />has been duly made, and a full diacharge and reI~mse c~ all claims or damage against us and
<br />o~ur co-operating interests and the' dredging company on ~ccouut of or arismng from the plac-
<br />ing of the dredged material on said area, from such land owners and such other parties as
<br />might be affected thereby;
