Ba.~e~ w~o spoke in
rega~tc that sectmon of the Tax Ordiuance relative to Nerchauts, aua oo~eo~ed to t~e
City Gcllector having the right to determine the fair~ rental cf a place of business located
in a building, part of which is used as a dwelllng;
On motion of Nr. Stewart, same was referred to the Gity Eanager and Gi%y Attorney;~

On motion, the privilege of the floor was granted N~. Ballard, who presented the
following: ~Norfolk, Va., April 4, 1931,

TO THE HONOP~BLE OtTY GOUNOlL OF THE OlTY OF PGRTSNDUTH:
Gate Er. L. C. Brinson, City Glerk,
Portsmouth, Va.

Gentlemen:- IN THE NATTER OF THE DEVELOPNENT
6F SOOTTS

Ne refer to alett? to us, dated Jauuary ?th, l~31~ from L.
~ ~at~ that at a meetin~ of your Honorable Body held cn January 6th, 1~31, you eon-
~e-~ ~-t~=repor~ to you, da~ed J~nuary 6th, 1931, by.your.co,mitre? appei~ted_"to 19ok"
into the matter of co-operating with the Ballard interesms aha others
Scetts Greek~, and enclosing a copy of that
Since the receipt ef that letter we have spent a g~eat deal cf time and thought
investigating the ~roposition-f=om every angle, Lncludingmauy interviews with the U. S.
Engineering Department and with dredging companies.
While we have every desire to co-operate with the Gity of Portsmouth and to com-
ply as fa~ as possible with yo~ wishes, we find that the question of costs makes the plans
set out in said report impracticable;~
We can not ~dertake te have a~y dredging done t~h~a~t is indicated on the~map m~de
by the U. S. Engineer, (el which.you have copy,) entitled "Norfolk N~=bor, Va. Scoffs ~G=eek.
Survey cf December 1930", accordmng to which map the d~edging in what we m~y call the east-
e~ b~anch of ~cotts Greek steps some distance Wes~ of your present bridge which crosses
same nea~. the Northern end of Elm Avenue; nor can we agree to anyrest=icted use by o~-
selves and co-ope=atlng interests cf the channel so far as ssme ma~ be d~dg~d~.except that
we recognize, as a matter ef~ course, that we muSt operate within our legal rign~s;~
The report of your committee sets forth in part:

"The portion cf a~ea E east of where t~e A.G.L. Railroad
crosses the creek, will take only about 16,000 cu. yds. of fill, but
can be utilized without any cost for permanent improvements at pres-
ent; The Oity would benefit ~o the extent of increased valuation on
about lOO, O00 sGuare feet of property which would be partially filled."

~ ~he ~ertion o~ area E designated can, in t~e co~se of ~he dredging operatigns,
be filled without exorbitant cost. We d~ not need thzs area for disposal cf ~redge material,
(arrangements havinE been otherwise made for adecuate disposal places). Bu~ zf th~ various
~rcper~y oWners of ~his e~Vea wish this area fille-dwith dredged material and a reasonable
sum ef money is paid us towards the cost of same, the City of Portsmouth, being in agreement
on the placing of the fill on this are~, ~e ~il~ have d~edged material disc~-~ged upon the
same te such height as may be approvtd by the Omty, not to exceed such heig~t-as maybe safe
and practicable, using the present fill on which the $tlantic Go,st Line Railroad passes the
Oreck as the retaining dike or darn.. Of course, after the d~edged ms. terial is ~ischa~ged
upon the said area, it will settle and neither we nor She dredging company are to be expect-
ed tc go 'back and again discharge material upon the area~ nor to guarantee maintenance of
the height. This proposition is further base~, as a condition precedent, upon the city per-
mitting the fill to be placed on area after the requestof the property owners of the area
has been duly made, and a full diacharge and reI~mse c~ all claims or damage against us and
o~ur co-operating interests and the' dredging company on ~ccouut of or arismng from the plac-
ing of the dredged material on said area, from such land owners and such other parties as
might be affected thereby;
Very Respectfully yours,

BALLARDFISH & OYSTER GO., INGORPORATED,
By W. A. Bal!ard,~P~esident,

For itself, Wainw~ight-Ayers-Oa~roll
~o~, I~ce~po~ated, and Is~o Fass,
Incorporated.~"

Motion elna.
