305 November 28, 1995 At a Called Meeting~o£ the City Council on Tuesday, November 28, 1995, ;there were present: Mayor Gloria O. Webb, Vice Mayor Johnny M. Clemons, *Bernard D. Griffin, Sr., James C. Hawks, James T. Martin, P. Ward Robinett, Jr., Ronald W. Massie, City Manager, G. Timothy Oksman, City Attorney. 95-517 - The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Council Chamber, 6th floor of City Hall, 801 Crawford Street, at 5:00 p.m., Tuesday, November 28, 1995, for the purpose of a Public Work Session. In addition, you may consider a motion to go into an Executive Session. By order of the Mayor." 95-518 - The following item was discussed in the Public Work Session: 1. Commission of Architectural Review Appeal 1055 Ann Street Motion by Mr. Clemons, and seconded by Mr. Martin, to concur with the recommendation of the Commission of Architectural Review to not allow the following changes: 1. Wrap all flat window and door trim with gray aluminum; 2. Wrap all flat fascia with gray aluminum; and 3. Wrap all flat soffit with white vinyl, and was adopted by unanimous vote. Motion by Mr. Robinett, and seconded by Mr. Clemons, to go into Executive Session pursuant to provisions of Section 2.1-344 of the Code of Virginia for the following: (1) Discussion or consideration of the condition, acquisition or use of real property for a public purpose, disposition of publicly held property, as permitted by Subsection (A) (3). ~ or the (2) Consultation with legal counsel and briefings by staff members, consultants or attorneys pertaining to actual or probable litigation, and discussion or consideration of specific legal matters requiring the provision of legal advice by counsel, as permitted by Subsection (A) (7) . (3) Discussion of the appointment of members to boards or conunissions by Portsmouth City Council, as permitted under Subsection (A) (1). The motion was adopted by unanamous vote. Motion of Mr. Robinett, and seconded by Mr. Martin, pursuant to Section 2.1-344.1 of the Code of Virginia certifying that ~o the best of the Council member's knowledge during the immediately preceding Executive Session of the City Council: (1) Only public bus~ness matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and (2) Only such public business matters as were identified in the motion by which the Executive Session was convened, were heard, discussed or considered in the meeting by the City Council.
