305 <br /> <br />November 28, 1995 <br /> <br /> At a Called Meeting~o£ the City Council on Tuesday, <br />November 28, 1995, ;there were present: <br /> <br /> Mayor Gloria O. Webb, Vice Mayor Johnny M. Clemons, <br />*Bernard D. Griffin, Sr., James C. Hawks, James T. Martin, P. <br />Ward Robinett, Jr., Ronald W. Massie, City Manager, G. Timothy <br />Oksman, City Attorney. <br /> <br />95-517 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be <br />held in the City Council Chamber, 6th floor of City Hall, 801 <br />Crawford Street, at 5:00 p.m., Tuesday, November 28, 1995, for <br />the purpose of a Public Work Session. <br /> <br /> In addition, you may consider a motion to go into an <br />Executive Session. <br /> <br />By order of the Mayor." <br /> <br /> 95-518 - The following item was discussed in the Public <br />Work Session: <br /> <br />1. Commission of Architectural Review Appeal <br /> 1055 Ann Street <br /> <br /> Motion by Mr. Clemons, and seconded by Mr. Martin, to <br />concur with the recommendation of the Commission of <br />Architectural Review to not allow the following changes: 1. Wrap <br />all flat window and door trim with gray aluminum; 2. Wrap all <br />flat fascia with gray aluminum; and 3. Wrap all flat soffit with <br />white vinyl, and was adopted by unanimous vote. <br /> <br /> Motion by Mr. Robinett, and seconded by Mr. Clemons, to go <br />into Executive Session pursuant to provisions of Section 2.1-344 <br />of the Code of Virginia for the following: <br /> <br /> (1) Discussion or consideration of the condition, <br />acquisition or use of real property for a public purpose, <br />disposition of publicly held property, as permitted by <br />Subsection (A) (3). ~ <br /> <br />or the <br /> <br /> (2) Consultation with legal counsel and briefings by staff <br />members, consultants or attorneys pertaining to actual or <br />probable litigation, and discussion or consideration of specific <br />legal matters requiring the provision of legal advice by <br />counsel, as permitted by Subsection (A) (7) . <br /> <br /> (3) Discussion of the appointment of members to boards or <br />conunissions by Portsmouth City Council, as permitted under <br />Subsection (A) (1). <br /> <br />The motion was adopted by unanamous vote. <br /> <br /> Motion of Mr. Robinett, and seconded by Mr. Martin, <br />pursuant to Section 2.1-344.1 of the Code of Virginia certifying <br />that ~o the best of the Council member's knowledge during the <br />immediately preceding Executive Session of the City Council: <br /> <br /> (1) Only public bus~ness matters lawfully exempted from <br />open meeting requirements by the Virginia Freedom of Information <br />Act, and <br /> <br /> (2) Only such public business matters as were identified <br />in the motion by which the Executive Session was convened, were <br />heard, discussed or considered in the meeting by the City <br />Council. <br /> <br /> <br />
