<br /> At a regular meeting ef the City Oouncil held April llth, I933, at 8:00 P.M.,
<br />there were present:

<br />Minutes of regular meeting held March 28th, were read and approved.
<br />
<br />The following communication from the Oity Manager was read:
<br />
<br /> "I am attaching statement showing adjustments given cons~ers and corrections made
<br />in water bills during the month of March,1933~ which shows adjustments were made in the amc~ut
<br />of $22.57 and corrections made due to errors in billing, etc., in the amount of $28.36.
<br /> I have asked the O ity Oolleotor to prepare a statement each month, in the future,
<br />that will show the adjustments and corrections m~de in water bills and to send a copy of the
<br />statement to the Oounci! and to my office in order that all concerned may know what ad~ust-
<br />merits and corrections are made..- The Oity Oolt ector has been authorized by me to make minor
<br />adjustments in water bills, he considers proper and has been requested to discuss with me all
<br />adjustments amounting to $10.00 or more before making= them. I believe this will give suffi-
<br />cient cheek and protection to the Oity on these items and I trust this arrangement will meet
<br />with your approval; if not, please advise how you wish this handled and I will so arrange."

<br />On motion of Mr. Rmtchins, the action of the 0ity Manager was approved.
<br />
<br />The followiug communication from the Oity Attorney was read:
<br />
<br /> ,The Supreme Oourt of Appeals of Virginia has disposed of all of the cases which
<br />were pending before it rela~ng te assessment for taxation of municipally ovn~ed water proper-
<br />ry. The cases were heard and the petition for a re-hearing was filed in one of the same-and
<br />the court- held in all-of the cases that the property is subject to taxation. Du~ing the lat-
<br />ter D~rt of ~he last year, I filed a petition in the Oircuit Oourt of Nansemond Oounty for the
<br />correction oz the assessment of the city property made by the officials of Nansemond Oounty.
<br /> After the decisions ef the Supreme Oourt had been rendered, Mr. Ohas. B. Godwin,
<br />Jr., O0mmo~ealth's Attorney of Nansemond Oou~ty, requested that we set a date for the hear-
<br />lng, or, if we preferred, to have a conference with a view to an amicable settlement. Mr. Da-
<br />vis and myself went into conference with the officials of Nansemond 0ounty and reached an
<br />agreement whereby they are willing to allow the court to place a smaller assessment upon ~he
<br />property than that fixed by the Oommissioner of the Revenue of the Oounty aud to'adjust the
<br />payment of the taxes.
<br /> In order to s~ttle this matter,, an appropriation out ef the funds of the Water
<br />Department in the sum of approximately $31,~00.00 will have te be made.
<br /> It will take considerable time for the Oouncil to go into this matter and as it
<br />is still pending in court, I believe a discussion should be had in Executive session. I,
<br />therefore, recommend that ~his letter be considered as a request for an appropriation ef
<br />$31,~O0.00 for the above purpose, which is introduced at this meeting of the 0ity Oouncil,
<br />and that it be laid on the table until the next meeting for its final passage and that be-
<br />tween now and the next meeting of the Oouncil either a special session or a conference be
<br />held on this Su~.ject. At this conference, Mr. Davis should be present. All figures are com-
<br />piled as of Aprzl 30th and the matter should be finally disposed of before that date.,,
<br />
<br /> Motion of Mr. Brooks to place on its first reading an appropria~on of $31,$00.00
<br />from Water Department fund for said purpose, was adopted.
<br />
<br /> Motion of Mr. Moore to refer the communication to a conference of the ~ou~cil to
<br />be called for ~ril 18th at 8:00 P.M. was adopted.
<br />
<br />UNFINISHED BUSINESS.
<br />
<br /> Application of Mr. H.H. Holcemb to install two tanks ef 550 gallons each, for
<br />storage of gasoline for sale on property located at the northwest intersection of Washington
<br />~ndEing Streets, to which objection was made, laid on table at last meeting until this meet-
<br />~ng, was taken up.
<br /> Privilege of the floor was gr~nted any interested in this matter, and the Super-
<br />intendent of Schools and Mr. Levin spoke against the application and Mr. Randall spoke in
<br />favor of application.
<br /> Motion of Mr. Hutchins to refer back to the Oity Manager fo~ him to take the ma~-
<br />ter up with the Traffic 0ommission and t.e report back at a special meeting April 18th at 8:00
<br />P.M., was adopted.
<br />
<br /> Motio~ cf M~. Hutchins to appropriate $1,232.O0 to purchase a new automobile for
<br />the Assistant Ohief ef Fire Department, to ~eplace auto that was wrecked, passed on first
<br />reading at last meeting, was taken up and on motion of Mr. Ogg, was adopted, and b~ the fei-
<br />lowing vote:

<br />
<br />Nays.- None.
<br />
<br />The following o~dinance laid on table at last meeting was taken up a~d read:
