<br /> to pay in November, 1934. ~ His contention is that the Oi~y owed him the money 'in November,
<br /> 193~, and that he could cml-set it on taxes.
<br /> As the aporopriation of $!200.00 had not been made in November, ?nd .the
<br /> resolution of June 12, 193~ favored the oayment specifically out of the 1935 budget,_mt apT
<br /> pears to me that Mr. Harper was not lega~!ly entitled to the off-set in November, 193~, or ~c
<br /> the relief asked for by him.
<br /> Section 242 of the Tax Code, states thatm the. compensation of the asses-
<br /> sors shall be prescribed by the 0ity Council, and in my opinion, this section places the pay-
<br /> ment cZ the compensation in the hands of the Oity Council."

<br />the building assessed at $200.00.~ I am now of the same opinion as stated in the previous
<br />letter, and I do not think that Mr. Brandon is entitled to any further rel~f."
