<br /> At a re~Glar meeting of the 0ity Council~ held July 23rd, 1935, at 8:00 P.M.,
<br />there were present:
<br />
<br />Vernon A. Brooks, Leslie T. Fox, W.R. Hu~chins, J. Alden Cast, J.R. Stewart,
<br />City Manager.
<br />
<br />Minutes of regular meeting held July 9th, were read and-approved.
<br />
<br />The following commmnication from the City Manager was read:
<br />
<br /> "In reference to the application of Mrs. Dicie Ve Martin, to ccnverZ a garage
<br />in the rear of 1531 Barton St., into a store building, which app!ication-was referred to me,
<br />by your honorable body, for investigation and report, on the merits of the same, I beg to
<br />report that the matter was submitted to the Traffic Commission and, after the mercers of the
<br />Commission visited the locality, a meeting was held on July 15th, and the following report
<br />and recommendation was made:
<br /> 'The first subject presented by the City Manger. for discussion
<br /> was an application to remodel a garage in the rear of premises
<br /> of Mrs. Dicie M~rtin, the property in question was in the rear
<br /> of 1531 Barton St., facing on First Ave., Just south of Barton.
<br /> After thoroughly discussing all phases of the situation, ~he
<br /> Oommission unanimously decided to recommend to the Manager that
<br /> ~the application be denied, the basis of denial being as fellows:
<br /> First, that this particular location was residential
<br /> and that no more commercial buildings should be allowed. The
<br /> Oommission realized that already there was a small store immedi-
<br /> ately in front of the proposed store, but this had been erected
<br /> years before the City controlled the erection of stores, etc., in
<br /> residential sections.
<br /> Second, that fire insurance ra~es would be necessarily
<br /> increased.
<br /> Third, that petitioners opposing conversion of garage
<br /> into store, live adjacent to site in question.
<br /> In view of the report and recommendation of the Traffic Commission, and fur
<br />ther realizing that in granting a permit fc~ a store in a residential district, such as this
<br />particular section is, a preceden~ may be established, which may cause embarrassing situa -
<br />tions in the future. I therefore recommend that the petition be not granted."

<br />On motion of Mr. Oast, the privilege of the floor was granted to any one in -
<br />
<br /> Mr. V.Lo Parker and Mr. B.B. Lipscomb spoke in favor of gr8nting said permit,
<br />and Mr. Jemmison spoke against granting said permit.
<br />
<br /> Motion of Mr. Stewart to concur in the Manager's recommendation, was adopted,
<br />and by the following vote:
<br />
<br />Ayes: Brooks, Fox, Hutohins, Oast, Stewart
<br />Nays: None.
