<br /> 3rd UP'lice Officer'E. R. ~tory was~acciden~ily sho~, in the discharge of
<br />his duties, on March 5th~ 1935. He was admitted to K!ngs Daughters Hosoltal, and his left leg
<br />w~s amputated~ between the knee and hip, by Dr. Collins. -
<br /> He was in' the hosoital five months.
<br /> H$ has b~en under'tHe constant care of Drso ROPer and Collins, amd is
<br />not yet released from medical supervision.
<br /> Mr. Story has been, and is now'bei~g,~carried on the Police payroll, at
<br />full pay, through a period of approximately eighteen months.
<br /> Had the City been disposed to have taken advantage of the Workmen, s Com-
<br />pensation Act, in this case Mr. Story would ha~e been paid $15.00 per week for 175 weeks, be
<br />ginning April 1st, 1935, in full 'satisfaction of the City's' legal obligation~ However, the ex-
<br />ceptional circumstances surrounding this case were taken into consideration, and the City did
<br />not fall back upon 'its legal rights, but continued the salary, and also.assumed the hospital
<br />
<br /> -- - Mr. Story was appointJd a substitU~ officer, on [FebrUarY'~i!~h, 1930,an~
<br />was'ap~°~nGed'~a'~ular *n'ApriI-12~h,193~. He was injured on March 5th, 1935, and at the time
<br />of the accident had been on the regular force eleven months only~

<br /> To this end, I am presenting, herewith, a resolution which was drawn by

<br /> "WHEREAS, Police Office~ ~Eldridge R. Story, while in the perform-
<br /> ante of his duties, sustained an injury, on the fifth day of March, 1935,
<br /> whereby he lost his left leg which incapacitates him for performing notice
<br /> duty; and -
<br /> WHEREAS, Eldridge ~. Story was awarded~y'th~Industria~ Commis-
<br /> sion of Virginia, the sum of Fourteen Dollars ($1~.00) per week from March
<br /> 12, 1935, to APril l, 1935, covering temporary total disability, and begin-
<br /> ning~o~il 1, 1935, Fourteen Dollars ($1~.O0) per week, for one hundred and
<br /> seventy five (1~5) weeks, covering loss of tef~ leg, payable every ~wo weeks;
<br /> and
<br /> WHEREAS, The City of Portsmouth has paid Eldridge R. Story a sum
<br /> equal to $135.65 per month, and has thereby been complying with the order of
<br /> the Industrial 0ommission:
<br /> NOW, TH~_~REFORE, Be .it resolved by .the Oouncil of the~ity of Ports-
<br /> mouth, that Eldridge R. Story be continue~d to be paid the.sumof ~ourteen
<br /> Dollars ($14.00) per week for the remaining par~ of said one ~hundred and
<br /> seventy-five (175) weeks, allowed for the losa of his leg, and that he be
<br /> thereafter paid the sum of Sixty Dollars ($60.00)' per month until'otherwise-
<br /> determined by the Oouncil of the City of Portsmouth, and that hebe required
<br /> ~o perform no duties for the City for such compensations#
<br />
<br /> Motion of Mr. Hutohins to lay on table until next meeting, was adopted.

<br /> 4th ~ ~For some time past, automobiles with loud speakers, have broadcast through
<br />the streets, to the disturbance and annoyance of pedestrians and those occupying nearby build,
<br />ingSo
<br /> Also, in some instances, radios have been stationed in doorways and in
<br />front of bmildings, amd p~ograms have been, loudly, b~oadcast, for the purpose of advertising
<br />and attracting custom, rs. Within the past year, I have received numerous complaints.
<br /> I am of the opinion, that, unless controlled, this will become more fro -
<br />quent and-disturbing. I, therefore, recommend adoption of the accompanying ordinance, which
<br />was draWn by the City Attorney.~ -
<br /> "AN OP~INANCE TO PROHIBIT THE USE OR OPERATION OF A RADI0'~ORANy
<br /> MECHANICAL SOUND-~KING DEVICE, TO THE A~NOYANCE OR INCONVENIENCE OF THE
