Hutchins to concur in the Managerts recommendation, was adopted. <br /> <br />3rd - "Last Hatch, the Federal Government, after long-drawn out negotiations <br />gave the City the right to reconstruct the bridge over Bain's Creek, leading to the C!'ty Park. <br /> Under the terms of that ruling, we must begin ghe bridge within twelve <br />months. <br /> I suggest that we proceed To secure bids as to cost, and if through our <br />back tax collections, which we will push after July let, we can~nd the money, we should have <br />this work done during the warm weather, as it would be more difficult and more costly in cold <br />weather. <br /> <br /> 'On motion ordered filed. <br /> 4th - ~In order to properly mark approache~ and highways leading into Ports- <br />'mouth, especially to the ferries, it is necessary to use some of the poles of the Virginia <br />Electric and Power Company, <br /> The Power Company is willing to grant this permission, provided the <br /> Company is relieved by the City of any legal responsibility to which the Company might be sub- <br /> Jected. <br /> A%~ached hereto is an ordinance and agreement, which I recommend, and <br /> which I ask that the Clerk read at this tlme~ <br /> <br />Ordinance - <br /> AN ORDINANCE TO ACCEPT AND TO AUTHORIZE AND DIRECT THE EXECUTION <br /> OF A CONTRACT BETWEEN THE CITY OF PORTSMOUTH AND VIRGINIA ELECTRIC AND <br /> POWER COMPANY, UNDER WHICH THE CITY IS GRANTED PERMISSION TO ATTACH TO <br /> AND MAINTAIN ON POLES OF SAID COMPANY SIGNS AND MARKERS FO~-THE REGULA~ <br /> TION OF PARKING OF V~HICLESAND ROUTING OF TRAFFIC INA ND THROUGH SAID <br /> CITY. <br /> Be it ordained by the ~ouncil of the City of Portsmouth: <br /> <br /> Section 1. That all ~nd singular the terms, conditions and pro <br />visions of the form of con~ract between the City of Portsmouth and <br />nia Electric and Power Company, by which said Company grants, upon the terms <br />and conditions therein set forth, permission to the City to attach to and <br />maintain on the poles of said Company signs and markers for theregulation <br />of the parking of vehicles and the routing of traffic in and through the <br />City (a copy of which form of contract is hereto attached as a part hereof), <br />be and the same are hereby accepted, and the City Nanager is hereby autho <br />rized and directed to affix thereto the seal of the City, and attest the <br />same and deliver the executed contract to said Company. <br /> <br /> Section 2. This ordinance shall be in full force amd effect from <br />and after thirty (30) days after its passage. <br /> <br />Agreement - <br /> THIS AGREEMENT, made this day of , 1937, between <br /> the CITY OF PORTSMOUTH, a municipal corporation of the Sta~e of Virginia <br /> (hereinmfter sometimes Called "City") party of the first part, and VIR - <br /> GINIA ELECTRIC AND POWER COMPANY, a Virginia corporation, (sometimes here- <br /> inafter called "Electric Company") party of the second ~part; <br /> WHEREAS, Electric Oompany conduc~s an electric light and power <br /> business within the said City and has its poles and wires located in the <br /> s~reets of the City; and <br /> WHEREAS, City has requested permission of the Electric Company to <br /> attach to and maintain on said polesand signs for the regulation of park- <br /> ing of automobiles and other vehicles and signs called Nighway~Markers to <br /> direct traffic ~through the City; and <br /> _ WHEREAS, Electric Company is willing t? grant said permission upon <br /> the terms and conditions hereinafter set forth, <br /> NO~, THEREFORE, THIS AGREEMENT WITNEStETH: That for and in consi- <br /> deration of the premises and upon the terms and conditions hereinafter set <br /> forth, the parties hereto do mutually and respectively covenant and agree <br /> as follows: <br /> 1. Electric Compar4v doth grant unto the City permission to <br /> attach to and main-rain on the electric light and power poles owned by <br /> Electric Company within the corporate limits of thesald City signs and <br /> markers not ~o exceed in size twelve (12) inches square, 'to regulate the <br /> parking of vehicles and routing of traffic in and through said City. <br /> 2. The bottom of said s~gns and marke~s shall be not less <br /> than seven (7) feet above the sidewalks an~ they shall be kept firmly at- <br /> tached To the poles and maintained in good and safe condition to avoid <br /> injury or damage to persom and property. <br /> 3. The City covenants and agrees that it will save harmless <br /> and indemnify Electric Company from any and all claims, demands, actions <br /> and suits on account of any injury to person or proper~y caused by or <br /> arising out of the attachment to and maintenance on said poles of said <br /> signs and marke~s, or any or either of them. <br /> <br /> IN WITNESS WHEREOF ~he City of Portsmouth has caused these presents <br />to be signed by Charles Fo Harper, its City Manager, and its corporate seal <br />to be hereto affixed and aZte$~ed by its Cl~y Clerk, under and pursmar~Z to <br />ordinance adopted by the Council of the City of ~ortsmouth on the <br /> <br /> <br />
