June 22nd. 193~ Motion of Hr. Hutchins to concur in the Managerts recommendation, was adopted. 3rd - "Last Hatch, the Federal Government, after long-drawn out negotiations gave the City the right to reconstruct the bridge over Bain's Creek, leading to the C!'ty Park. Under the terms of that ruling, we must begin ghe bridge within twelve months. I suggest that we proceed To secure bids as to cost, and if through our back tax collections, which we will push after July let, we can~nd the money, we should have this work done during the warm weather, as it would be more difficult and more costly in cold weather. 'On motion ordered filed. 4th - ~In order to properly mark approache~ and highways leading into Ports- 'mouth, especially to the ferries, it is necessary to use some of the poles of the Virginia Electric and Power Company, The Power Company is willing to grant this permission, provided the Company is relieved by the City of any legal responsibility to which the Company might be sub- Jected. A%~ached hereto is an ordinance and agreement, which I recommend, and which I ask that the Clerk read at this tlme~ Ordinance - AN ORDINANCE TO ACCEPT AND TO AUTHORIZE AND DIRECT THE EXECUTION OF A CONTRACT BETWEEN THE CITY OF PORTSMOUTH AND VIRGINIA ELECTRIC AND POWER COMPANY, UNDER WHICH THE CITY IS GRANTED PERMISSION TO ATTACH TO AND MAINTAIN ON POLES OF SAID COMPANY SIGNS AND MARKERS FO~-THE REGULA~ TION OF PARKING OF V~HICLESAND ROUTING OF TRAFFIC INA ND THROUGH SAID CITY. Be it ordained by the ~ouncil of the City of Portsmouth: Section 1. That all ~nd singular the terms, conditions and pro visions of the form of con~ract between the City of Portsmouth and nia Electric and Power Company, by which said Company grants, upon the terms and conditions therein set forth, permission to the City to attach to and maintain on the poles of said Company signs and markers for theregulation of the parking of vehicles and the routing of traffic in and through the City (a copy of which form of contract is hereto attached as a part hereof), be and the same are hereby accepted, and the City Nanager is hereby autho rized and directed to affix thereto the seal of the City, and attest the same and deliver the executed contract to said Company. Section 2. This ordinance shall be in full force amd effect from and after thirty (30) days after its passage. Agreement - THIS AGREEMENT, made this day of , 1937, between the CITY OF PORTSMOUTH, a municipal corporation of the Sta~e of Virginia (hereinmfter sometimes Called "City") party of the first part, and VIR - GINIA ELECTRIC AND POWER COMPANY, a Virginia corporation, (sometimes here- inafter called "Electric Company") party of the second ~part; WHEREAS, Electric Oompany conduc~s an electric light and power business within the said City and has its poles and wires located in the s~reets of the City; and WHEREAS, City has requested permission of the Electric Company to attach to and maintain on said polesand signs for the regulation of park- ing of automobiles and other vehicles and signs called Nighway~Markers to direct traffic ~through the City; and _ WHEREAS, Electric Company is willing t? grant said permission upon the terms and conditions hereinafter set forth, NO~, THEREFORE, THIS AGREEMENT WITNEStETH: That for and in consi- deration of the premises and upon the terms and conditions hereinafter set forth, the parties hereto do mutually and respectively covenant and agree as follows: 1. Electric Compar4v doth grant unto the City permission to attach to and main-rain on the electric light and power poles owned by Electric Company within the corporate limits of thesald City signs and markers not ~o exceed in size twelve (12) inches square, 'to regulate the parking of vehicles and routing of traffic in and through said City. 2. The bottom of said s~gns and marke~s shall be not less than seven (7) feet above the sidewalks an~ they shall be kept firmly at- tached To the poles and maintained in good and safe condition to avoid injury or damage to persom and property. 3. The City covenants and agrees that it will save harmless and indemnify Electric Company from any and all claims, demands, actions and suits on account of any injury to person or proper~y caused by or arising out of the attachment to and maintenance on said poles of said signs and marke~s, or any or either of them.
