May 28, 1996 <br /> <br />(h) The project provides parking, building access and <br />pathways for persons with disabilities in accordance with <br />requirements of the Americans with Disabilities Act. <br /> <br />the <br /> <br /> 2. That a group housing use permit for the construction <br />of ninety-two apartment units on Tejo Lane, Portsmouth, <br />Virginia, is hereby granted to the applicant, Tow-ne <br />Development Corporation, subject to the following terms and <br />conditions: <br /> <br /> (a) The group housing project shall be limited to s~x <br />buildings containing a total of ninety-two apartment units. <br /> <br /> (b) The project shall be constructed with full brick <br />front facades below the large gables of the front and rear <br />sides of each building. Vinyl "cedar shakes" shall be <br />employed on all gable areas on the front and rear faces of <br />each building, as shown on the attached Exhibit A. Buildings <br />A and F shall have full brick facades on their sides facing <br />Tejo Lane. A revised plan showing the placement of brick <br />shall be approved by the Director of Planning prior to the <br />issuance of any building permits. <br /> <br /> (c) A landscaping plan shall be developed in accordanoe <br />with the attached Exhibit B. All exterior utility cabinets <br />(including the air conditioning units) shall be landscaped. <br />A landscaping plan showing shrubs around the building <br />foundations shall be submitted to the Planning Department for <br />review and approval prior to the issuance of any building <br />permits. <br /> <br /> (d) Adequate lighting shall be installed in the parking <br />area. A plan showing the lighting layout shall be submitted <br />by the applicant and approved by the Traffic Engineer prior <br />to issuance of any building permits. <br /> <br /> (e) The site plan shall be developed in accordance with <br />the attached Exhibit C. <br /> <br /> (f) Any revmsaons to the site plan, to the landscaping <br />plan, or to any elevation made through the group housing <br />application process, including any changes in response to any <br />requirements by the City Council, must be submitted to the <br />Planning Department for review and approval prior to the <br />issuance of any building permits. <br /> <br /> (g) The applicant shall be responsible for the cost of <br />upgrading utilities required for the construction and <br />operation of this project. <br /> <br /> (h) The applicant and any successor in interest shall <br />comply with all applicable statutes, ordinances and <br />regulations of federal, state and local governments and shall <br />obtain and maintain in effect all required permits. <br /> <br /> (i) EXPIRATION OF PERMIT: Pursuant to Section 40-115 of <br />the Code of the City of Portsmouth, Virginia (1988), the <br />group housing use permit will expire if the applicant fails <br />to apply for all building permits for the entire project <br />within one year of the adoption of this resolution or if it <br />fails to secure an <br />extension of the expiration deadline as provided in said Code <br />section. <br /> <br /> (j) REVOCATION OF PERMIT: Violation Of any of the above <br />conditions may serve as grounds for revocation of the permit <br />by the City Council.,, <br /> <br />Ayes: Clemons, Griffin, Hawks, Martin, Pitts, Robinett, Webb <br />Nays: None <br />Abstained: Martin - previously represented applicant <br /> <br /> <br />
