<br />At a regular meeting of the City Councils held June !3th, 1744, there were
<br />
<br />John P. Leigh, Leslie T. Fox, Russell N. Hall, James N~ Howard,
<br />W~ R~ Hutchins, F~ank D. Lawrence, O~ E. Warren,Pearle J. Wilson
<br />and Arthur $m Owens, City Manager.
<br />
<br /> The minutes of the regular meeting of the Council, held on May 23rd, and
<br />special meeting of June 6th were read and ~oproved.
<br />
<br /> On motion of Mr. ~arren, the privilege of the floor was granted Mrs. Ada
<br />Campbell, who complained that the Manager had not appointed her as special Policewoman.
<br />
<br />Motion of Mr. Fox to go i nrc an executive session, was adopted.
<br />
<br />The Manager presented the following letter from the City Attorney:
<br />
<br /> "There is pending in the Circuit Court of the City of Portsmouth a suit
<br />brought against the City by Jos~oh D~ Aueley wherein he seeks to recover damages in the sum
<br />O~ ~§,000o00 for injuries sustained by falling inthe street in front of the market bui!din~
<br />in Seaboard St., on March 25, 19~. The City had caused water from the basement of the bui~d-
<br />ir~ to be disoharged in the street, and Mr. Ausley in attempting to cross the street slipped
<br />and fell, breaking the ulna bone in his arm at the elbow. It became necessary to wire the
<br />bone together and he has a permanent limitation of motion° He has agreed to.compromise the
<br />case for $~9,O0 ~nd court costs. I recommend that I be authorized ~o compromise the case
<br />for the above ~mount and that an ~o~ropriation of $999.00 be made for that purpose. ~r~ Aus-
<br />ley has had considerable expense and may again return to the hospital."
<br />
<br /> Motion of Mr. Howard to concur in the Attorney's recommendation, and to
<br />appropriate $999~00 for said purpose, was adopted and by the following vote~
<br />
<br />Ayes: Leigh, Fox, Hall, Howard~ Hutohins, Lawrence, Warren, Wilson
<br />Nays: None
<br />
<br /> Mr. Lawrence asked permission for t he American National Bank to extend its
<br />cellar under the sidewalk of Middle and High Sts.
<br />
<br /> Motion of Mr~ Fox to grant said permission, subject to the aporoval of the
<br />City Attorney and City Engineer~ was adopted.
<br />
<br />The following communications from the City Y~nager were read~
<br />
<br /> let "The CAlnaught Construction Company, under Project VA 44-324 -
<br />Storm Drains and Sidewalks, is requesting an extension of time under their contract, and I am
<br />therefore requesting that the attached resolution be adopted."
<br />

<br />under Contract VA 44-324 for the constrmction of
<br />Storm Drains and Bidswalks~ has been called upon to
<br />do additional work under our requested c~nge orders,
<br />and
<br /> ~hereas~ this has t~ken extra time over their
<br />regular ~ontract period,
<br /> T~erefore, Be ~t Resolved by the Council of the
<br />City of Portsmouth that the Calnaught Construction Com~
<br />pany be granted an extension ~ f 'ti~e to June lOth~lg~,
<br />subject to the ~oproval of the Federal Works Agency.~
<br />
<br />On motion of Mr~ Lawrence, said resolution was adopted.

<br />this has ~taken ex~ra t~me over their regu±ar contract peri~d,
<br />
<br /> Therefore, Be it Resolved by the Council of the
<br />City of Portsmouth, Va., that the-Coder Incinerator Corpor~
<br />ation be g ranted a time extension from February lyth~lg~4
<br />to April 22nd, 1~44; this being subject to the approval of
<br />the Federal Works A~ency.~

<br /> 3rd - "Please authorize the City Mansger to execute two contracts with
<br />~tates Selective Service Headquarters for t~he u~e of the following property:

<br /> let ~ Rooms l~ and 19 on the first floor of the City ~arket
<br /> building; $25.00 per month for one year ~o June ~Oth,!945.
<br />
<br /> 2nd Space on first floor of the Barlow Building; $125.00 per
<br /> month for one year to June 30th~ 1945."
