Lockwood, General Contractor on t he Pinners <br />Point Sewage Treatment Plant has extended over his contract <br />period for completion, and <br />~[HEREAS, the d clay was definitely beyond the control o f the <br />eo~tractor, b~ing due to shortages of reinforcing steel, c e- <br />merit and .delays in delivery of the mechs_nical equipment and <br />the electrical control centers. <br />THEt~0RE, BE IT RESOLVED B~ TRE COUNCIL OF T~IE CITY OF <br />PORTSMOUTH, VIRGY~IA, that C. ~. Lockwood be grmuted an exten- <br />sion of time from the original ~expiration date of January 23rd, <br />194~, to April 23rd, 19~9, a period of 90 days on said contract <br />without liquidated damages, provided the contractor waives any <br />claim for damages due to the City's operati~on of part of the <br />works, as these conditions apply to the completion of the re - <br />mainder of ~the work on the-project by the contractor, and the <br />Contractor's surety ~pproves the extension e f time with a proper <br />amendment to the Performance Bond." <br /> <br /> 3rd -- ~I should like your approval to renew, for another year, the rent <br /> B ~ <br />agreement on the concession stand in the City Park, now-bei~g operated by Fred E. a~ley.~ <br /> <br />Motion of Mr. Wilson to concu~ in the Manager's recommendation, was adopted <br /> <br /> 4th - ~'Under date of Jmue 7th~ 19~6, the City of Portsmouth, Virginia, <br />entered into a contract with.the Virginia Smelting ~ompany in which it agreed to pay to the <br />Virginia Smel~ing Company the sum of T_hirty-th~ee Hundred amd ttii~y~three Dollars and thirty- <br />three cents ($3~33.33) at the end af each yearly perzo$, p~ov~ded.~.e Vzrg~n~a ~eltzng Compan <br />had paid to the City as much a s_Five Thousand Dollars(tS,000.00) for wa~er furnished by the <br />City during the orevious twelve months. At She t~e the contract was executed~ it was antici- <br />pated that the wkter line to West Norfolk woul~ cost Fort~-~ve.Thousan~ ?011ars ($45,000.00) <br />and the Virginia Smelting Company was to advance ~ne-third of the c ~st whi'ch was to be ~efund- <br />ed by ~the City over a period of four and one-half years. <br /> ~ae extension cost more than $45,000,00 and the City required the <br />Virginia Smelting Company to advance $591.00 additi3nal. The ~ater line was placed in opera- <br />~ion in,M~y, 1947, and for the first one year period ending ~hae 1st, 1948, the Virginia Smelt- <br />ing Company paid the City the stm.~ of $9,815.79, and from June l, 1~$ to February l, 19~9, it <br />has paid the sum of $5,414.32. <br /> I suggest that the additional sum of $591.00 be pro-rated over <br />the s~me peri~d, and I therefore request ~u aopropriation of. $6,939.~76 out of the ~ater funds, <br />out of which $3,!64.88 is to be paid at this ~ime and $3,46~.88 on June 1st, 1949o~ <br /> <br /> Motion o f~lr. Howard to place an appropriation of $6,9~$.76 out of Water <br />Department fonds, on its first reading, for said purpose, was adopted. <br /> <br /> 5th - ~At the last meeting o£ the City Ooun¢il you referred back to me <br />the question of th~ petition for the opening of King St. between Hamilton ~venue sm.d Loudon <br />Avenue.
