0.1'8 <br /> <br />Janua~ 14.1997 <br /> <br /> (f) The facility shall be inspected annually by the Health Department, Fire <br />Department and the Building Official's Office: <br /> <br /> (g) The applicant shall comply with all applicable codes, ordinances and <br />regulations of federal, state and local governments; and, shall obtain and maintain <br />necessary licenses and permits. <br /> <br /> (h) All food preparation facilities must meet all applicable City Fire and <br />Building Code requirements. <br /> <br /> (i) The entire rear yard shall be enclosed with stockade fencing six feet in <br />height along the side and rear property lines. Fencing facing the front of the subject <br />property shall be four feet in height. <br /> <br /> 4. EXPIRATION OF PERMIT: If operation of the facility is not commenced <br />within two years of the date hereof, the use permit shall expire. <br /> <br /> 5. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Clemons, Griffin, Martin, Pitts, Robinett Holley <br />Nays: Berm <br /> <br /> 96-408 (c): <br /> <br /> Motion by Mr. Robinett. and seconded by Mr. Martin, to adopt the following <br />resolution, approved at the December 17, 1997 Public Hearing meeting, and was <br />adopted by the following vote: <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT FO R THE CONSTRUCTION <br />OF A COMMUNICATIONS TOWER AT 1050 HODGES FERRY ROAD. <br /> <br /> WHEREAS AT&T Wireless Services. Inc., has made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />granting of a use permit to construct a communications tower to be located at 1050 <br />Hodges Ferry Road Portsmouth, Virginia. as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br /> required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said <br /> use permit with conditions. <br /> <br /> NOW. THEREFORE, BE IT RESOLVED by the Council of the City of <br /> Portsmouth Virginia: <br /> <br /> 1. That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br /> working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the properbj or <br /> improvements in the neighborhood: <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br /> surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br /> driveways, and curb cuts which will provide for safe and convenient traffic <br /> movement; and <br /> <br /> <br />
