0.1'8 Janua~ 14.1997 (f) The facility shall be inspected annually by the Health Department, Fire Department and the Building Official's Office: (g) The applicant shall comply with all applicable codes, ordinances and regulations of federal, state and local governments; and, shall obtain and maintain necessary licenses and permits. (h) All food preparation facilities must meet all applicable City Fire and Building Code requirements. (i) The entire rear yard shall be enclosed with stockade fencing six feet in height along the side and rear property lines. Fencing facing the front of the subject property shall be four feet in height. 4. EXPIRATION OF PERMIT: If operation of the facility is not commenced within two years of the date hereof, the use permit shall expire. 5. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Clemons, Griffin, Martin, Pitts, Robinett Holley Nays: Berm 96-408 (c): Motion by Mr. Robinett. and seconded by Mr. Martin, to adopt the following resolution, approved at the December 17, 1997 Public Hearing meeting, and was adopted by the following vote: "A RESOLUTION GRANTING A USE PERMIT FO R THE CONSTRUCTION OF A COMMUNICATIONS TOWER AT 1050 HODGES FERRY ROAD. WHEREAS AT&T Wireless Services. Inc., has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to construct a communications tower to be located at 1050 Hodges Ferry Road Portsmouth, Virginia. as hereinafter-described; and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW. THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use; (b) Will not be detrimental to the public use or injurious to the properbj or improvements in the neighborhood: (c) Will be provided with sufficient landscaping to insure compatibility with surrounding uses; (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and
