Bilisoly~Jr.,~Fred A. Duke, George L. Grimes~ Car! C. <br />Houghton~ Jr., James N. Howard~ R. Irvine Smith, E. Robie <br />Sturtevant~ C. E. W~rren~ Earl Weiseman~ Pearle J. Wilson~ <br />I. G. Vass~ City Mansger~ aud R.C. Barclay~ City Attorney. <br /> <br />Pearle J. Wilson~ Vice Mayor~in the Chair. <br /> <br />The following report from the Planning and Zoning Commission was read: <br /> <br /> "Pursuant to the provisions of the Zoning 0rdinance~ notice is hereby <br />given that a public hearing will be held at 7:30 P.M.~ on Tuesday~ September 26th, 1950~ in <br />the Court of Hustings Court Room~ Court House Building~ Portsmouth~ Virginia~ for the pur- <br />pose of altering zones ~uud reclassifying the following~operty: <br /> <br />#l. Northeast corner of'County St. and Fourth Avenue, 90 feet <br /> x lO~ feet from Residential Class C to Local Business Class F." <br /> <br />mission was adopted. <br /> <br />Motion of Mr. Duke to concur in the recommendation of the Planning Cpm- <br />The following reports from the City Manager were read: <br /> <br /> 1st - "I sm submitting herewith an agreement for the construction of an <br />eight inch water main across the Atlantic Coast Line Railroad right C way at Powhatan Avenue <br />and recommend that you authorize the City Manager to execute the agreement on .behalf of the <br />City." <br /> <br /> Motion of Mr. Houghton that theCity Manager be authorized to sign the <br />agreement, was adopted. <br /> <br /> 2nd - "At the last regular meeting of the City Council, the question of <br />opening D~ke Street from Effingham to I~Yashington Street: was ~ferred to me for a report. <br /> I h~v%in the presence of our City Engineer, inspected this <br />street and the City Engineer advmses me that mt will require 800 feet of culvert or concrete <br />pipe drainage that will cost approximately $50.00 per lineal foot or a total of $~0~000.00 <br />plus the construction of the street which will run,to a considerably higher figure. At the <br />present time~ I do not believe that the project will justify this amount of expense." <br /> <br />On motion filed. <br /> <br /> Srd - -~ am s~bmit~ing the amount of the cost of recording fees for the <br /> appeal case of Culpepper ws. City of ?ortsmouth~ in the sum of 9780.00 and I recommend that an <br />appropriation in this amount be placed on its first reading." <br /> <br /> Motion of Mr. Warren tO place an appropriation of 9780.00 for said pur- <br />pose on its first reading: was adopted. <br /> <br /> 4th - "I reco~m~end that an appropriation of $300.00 be placed on its <br /> first reading for the purpose of paying to Virgil P%unkett~ Attorney for Walter H.Parker,Sr., <br /> the sum agreed to in the transfer of the parcel of land ovmed by the City to ~. Parker." <br /> <br /> Motion of Mr. Duke to place sn appropriation of $300.00 for said purpose <br /> on its first reading, was adopted. <br /> <br /> 5th "I have been ~dvised by the Portsmouth Public Schools that there <br /> is s final payment due on the Jokn Tyler School in the sum of $~083.1~. Since the ~lance of <br /> the School Fu~d in the specialbarak account,s been transferred to the General Fund~ I rec- <br /> ommend that an appropriation in~e above amount be placed on its first reading~ the funds to <br /> be paid from the Utility Tax Fund." <br /> <br /> Motion of Mr. Warren to place s~ appropriation of.~O83.1g for said <br /> purpose, on its first reading, was adopted. <br /> <br /> 6th - "You referred to me at a preyS_pus meeting of the Council the <br /> question of the City employees participating in the Federal Social Security benefits. <br /> Please be advised that I have reached the conclusion that the <br /> only way city employees can oartieipate~the benefits is tb~ough the State of Virginia and <br /> this would require an enactment of legislation by the State before municipal employees can <br /> benefit from the Social Security Act." <br /> <br /> Motion of Mr. Howard to lay on the table and that the City Manager keep <br /> the Council advised~ w~s adopted. · <br /> <br /> 7th - "I recommend that the City Auditor and Collector be authorized <br /> to transfer the amount of $7~000.00 from the Utility TaxFund to the General Fund, in order <br /> to enable the City to curtail notes due at the bank in the sum of $200~000.00; said refunds to <br /> be~ replaced in the Utility Fund in thirty days from the~of transfer." <br /> <br /> Motion of Mr. Grimes to concur in the reco~mendationof the City Manager <br /> was adopted. <br /> 8th - "I recommend that an appropriation in the sum of '$~00.00 be <br /> placed on its first reading to ~fray the s~pense of Civili~m Defense." <br /> <br /> <br />
