May 8, 2001 <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic movement; <br />and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br />2. That Johnathan Boggs is hereby granted a use permit pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a <br />restaurant on property located at 440 High Street, and being more particularly described <br />as: <br /> <br />UP-01-06 <br /> <br /> Beginning at the northeast corner of the intersection of <br />High Street and Dinwiddie Street; thence, north 79.92'+ to a <br />point; thence, east 89.4'+ to a point; thence, south 8.9'+ to a <br />point; thence, west 45.0'+ to a point; thence, south 71.0'+ to a <br />point; thence, west 45.0'+ to the point of the beginning. <br /> <br />3. That the use permit is approved subject to the following conditions: <br /> <br /> (a) Occupancy shall be limited to fifty people or to such smaller number as the <br />Fire Marshall shall establish. <br /> <br /> (b) <br />p.m. daily. <br /> <br />The hours of operation shall be limited to between 10:00 a.m. and 11:00 <br /> <br /> (c) The applicant shall develop a plan for trash storage, handling, and <br />removal and shall submit the plan for approval to the Director of Parks, Recreation, and <br />General Services prior to commencement of operations. <br /> <br /> (d) The applicant and any successor in interest shall comply with all <br />applicable codes, ordinances, and regulations of federal, state and local governments <br />and shall obtain and maintain in effect all necessary licenses and permits. <br /> <br /> (e) All taxes and fees in connection with the subject property and operation <br />shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above conditions may <br />serve as grounds for revocation of the use permit by the City Council." <br /> <br />Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley <br />Nays: None <br /> <br /> Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following <br />resolution, approved at the April 24, 2001 meeting, and was adopted by the following <br />vote: <br /> <br />01-134(c): <br /> <br />"A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT <br />(GHP-01-02) TO PERMIT FOUR APARTMENT UNITS AT 525 HIGH STREET. <br /> <br /> WHEREAS, Dan E. Griffin, A.I.A., agent for the owner of the subject property, <br />Lethal Holding Corporation, has made application pursuant to Section 40-112 of the <br />Code of the City of Portsmouth, Virginia (1988), as amended, for the approval and <br />granting of a group housing permit for four apartment units at 525 High Street, <br />Portsmouth, Virginia, more particularly described as follows: <br /> <br />GHP-01-02 <br /> <br /> Beginning at a point 150' +/- from the southwest <br />intersection of Dinwiddie Street and High Street; thence, <br />west 30' +/- to a point; thence, south 115' +/- to a point; <br />thence, east 32' +/- to a point; thence, north 115' +/- to the <br />point of the beginning. <br /> <br /> <br />
