May 8, 2001 (d) Will be a project that will be developed according to a plan for parking, driveways, and curb cuts which will provide for safe and convenient traffic movement; and (e) Will be in accordance with the purposes of the City of Portsmouth Zoning Ordinance. 2. That Johnathan Boggs is hereby granted a use permit pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the operation of a restaurant on property located at 440 High Street, and being more particularly described as: UP-01-06 Beginning at the northeast corner of the intersection of High Street and Dinwiddie Street; thence, north 79.92'+ to a point; thence, east 89.4'+ to a point; thence, south 8.9'+ to a point; thence, west 45.0'+ to a point; thence, south 71.0'+ to a point; thence, west 45.0'+ to the point of the beginning. 3. That the use permit is approved subject to the following conditions: (a) Occupancy shall be limited to fifty people or to such smaller number as the Fire Marshall shall establish. (b) p.m. daily. The hours of operation shall be limited to between 10:00 a.m. and 11:00 (c) The applicant shall develop a plan for trash storage, handling, and removal and shall submit the plan for approval to the Director of Parks, Recreation, and General Services prior to commencement of operations. (d) The applicant and any successor in interest shall comply with all applicable codes, ordinances, and regulations of federal, state and local governments and shall obtain and maintain in effect all necessary licenses and permits. (e) All taxes and fees in connection with the subject property and operation shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." Ayes: Benn, Griffin, Moody, Pitts, Robinett, Whitehurst, Holley Nays: None Motion by Mr. Pitts, and seconded by Mr. Whitehurst, to adopt the following resolution, approved at the April 24, 2001 meeting, and was adopted by the following vote: 01-134(c): "A RESOLUTION GRANTING APPROVAL FOR A GROUP HOUSING USE PERMIT (GHP-01-02) TO PERMIT FOUR APARTMENT UNITS AT 525 HIGH STREET. WHEREAS, Dan E. Griffin, A.I.A., agent for the owner of the subject property, Lethal Holding Corporation, has made application pursuant to Section 40-112 of the Code of the City of Portsmouth, Virginia (1988), as amended, for the approval and granting of a group housing permit for four apartment units at 525 High Street, Portsmouth, Virginia, more particularly described as follows: GHP-01-02 Beginning at a point 150' +/- from the southwest intersection of Dinwiddie Street and High Street; thence, west 30' +/- to a point; thence, south 115' +/- to a point; thence, east 32' +/- to a point; thence, north 115' +/- to the point of the beginning.
