May 13, 1997 <br /> <br /> At a Called Meeting of the City Council on Tuesday, May 13, 1997, there were <br />present: <br /> <br /> Mayor James W. Hoiley Ill, *Vice Mayor Johnny M. Clemons, Bernard D. <br />Griffin Sr.. James T. Martin, Cameron C. Pitts, P. Ward Robinett, Jr., J. Thomas <br />Benn Ill. Ronald W. Massie. City Manager, G. Timothy Oksman. City Attorney~ <br /> <br />97-138 - The following call for the meeting was read: <br /> <br /> "Please attend a Called Meeting of the City Council to be'held in the City <br />Council Chamber, 6th floor of City Hall, 801 Crawford Street. at 5:00 p.m.. Tuesday, <br />May 13, 1997, for the purpose of a public work session. <br /> <br />In addition, you may consider a motion to go into an Executive Session. <br /> <br />By order of the Mayor." <br /> <br />97-139 - The following items were discussed in Public Work Session: <br /> <br />1. Commission of Architectural Review Appeal <br /> <br /> Motion by Mr. Martin and seconded by Mr. Griffin, to concur with the <br />recommendation to deny the application to install vinyl siding at 408 Mount Vernon <br />Avenue, and was defeated by a vote of 3-4 (Clemons, Griffin, Robinett. Holley). <br /> <br />2. Third Hampton Roads Crossing <br /> <br />3. City's Retail Advertising Campaign <br /> <br /> Motion by Mr. P, obinett, and seconded by Mr. Benn, to go into Executive - <br />Session pursuant to provisions of Section 2.1-344 of the Code of Virg~ mia for the <br />following: <br /> <br /> (1) Discussion of appointments by Council to committees, boards, or <br />commissions, as permitted by Subsection (A)(1). <br /> <br /> (2) The condition or use of real property for a public purpose, or the <br />disposition of publicly held property, as permitted by Subsection (A)(3). <br /> <br /> (3) A prospective business or industry or expansion of an existing business or <br />industry where no previous announcement has been of same in the community, as <br />permitted by Subsection (A)(5). <br /> <br /> (4) Specific legal matters requiring the provision of legal advice by counsel, <br />as permitted by Subsection (A)(7). <br /> <br />The motion was adopted by unanimous vote. <br /> <br /> Motion of Mr. Martin, and seconded by Mr. Benn, pursuant to Section 2.1- <br />344.1 of the Code of Virginia certifying that to the best of the Council member's <br />knowledge during the immediately preceding Executive Session of the City Council: <br /> <br /> (1) Only public business matters lawfully exempted from open meeting <br />requirements by the Virginia Freedom of Information Act, and <br /> <br /> (2) Only such public business matters as were identified in the motion by <br />which the Executive Session was convened, were heard, discussed or considered in <br />the meeting by the City Council. <br /> <br /> <br />
