138 <br /> <br />97-141 (c): <br /> <br /> "A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A <br />MISCELLANEOUS RETAIL FACILITY AT 3535 AIRLINE BOULEVARD. <br /> <br /> WHEREAS China Market Enterprises, Ltd., has made application pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the <br />granting of a use permit to operate a miscellaneous retail facility (S.I.C. 59) to be <br />located at 3535 Airline Boulevard, Portsmouth, Virginia, as hereinafter-described; <br />and <br /> <br /> WHEREAS, the applicant and the Planning Director have done all things <br />required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the granting of said <br />use permit with conditions. <br /> <br /> NOW. THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth. Virginia: <br /> <br />1 That the use for which the permit hereinafter-described is sought: <br /> <br /> (a) Will not adversely affect the health and safety of persons residing or <br />working in the neighborhood of the proposed use; <br /> <br /> (b) Will not be detrimental to the public use or injurious to the property or <br />improvements in the neighborhood; <br /> <br /> (c) Will be provided with sufficient landscaping to insure compatibility with <br />surrounding uses; <br /> <br /> (d) Will be a project that will be developed according to a plan for parking, <br />driveways, and curb cuts which will provide for safe and convenient traffic <br />movement; and <br /> <br /> (e) Will be in accordance with the purposes of the City of Portsmouth Zoning <br />Ordinance. <br /> <br /> 2. That China Market Enterprises, Ltd., is hereby granted a use permit <br />pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for <br />the operation of a miscellaneous retail facility on property located at 3535 Airline <br />Boulevard, and being more particularly described as: <br /> <br />UP-97-11 <br /> <br /> Beginning on the south right-of-way line of Airline Boulevard a distance of <br />186.09 feet west from its intersection with Elmhurst Lane; thence continuing west <br />along Airline Boulevard a distance of 360 feet to a point; thence south 188.35 feet to <br />a point; thence west 132.73 feet to the east right-of-way line of Greenwood Drive; <br />thence southerly along said right-of-way 681.95 feet to a point; thence east 151.40 <br />feet to a point; tlnence southerly 170 feet to a point; thence southwest 14 feet to the <br />north right-of-way line of Garwood Avenue: thence easterly along said right-of-way <br />566.03 feet to a point; thence northerly 135.73 feet to a point; thence easterly 11.1.03 <br />feet to the west right-of-way line of Elmhurst Lane; thence northerly along said right- <br />of-way 625.76 feet to a point; thence west 185.35 feet to a point; thence northerly <br />202.04 feet to the south right-of-way line of Airline Boulevard, the point of origin. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) All activity must be conducted inside the building. <br /> <br /> <br />
