55-259 - The following petition was presented:
"We, the undersigned owners of ~alI properly fronting or abutting on the 3800 block of Bright~
Street, respectfully petition the City of Portsmouth to ban and prohibit the parking of motor vehicles along the
north and south sides o~ the 3~00 block of Brighton Street, between Halifax Avenue and Rodman Avenue. We furthe~
As owners and residents, we have given due consideration to the possible inconveniences such
parking restrictions might cause us. However, in the interest of public safety, we feel such restrictions are
necessary for the following reasons:
1. The heavy accumulations of transient vehicle ~arking freqMently obstructs the free
use of this public road to such an extent that ~this condition has become s distinct
hazar~ to the health, morals smd safety of the general public.
The heavy cor~centration 'Of parked vehicles impedes and often bars the passage of
private, p~lic and emergency vehicles alike.
S. Further, the heavy parking in this block intensifies and co~pounds the hazards ro
th~ pedestrian users due ~o the fact that ther% are no sidewalks in this block and
pedestrians are forced into the roadway hy the parked vehicles which Span the
s~houlders and part of the pavement.
4. Further, the progress ~f Vehicles attempting turns from Rodman Avenue into Brighton
Street, is often impeded by the presence of parked vehicles on Brighton Street. ~otor-
ists, finding themSelves nnable to proceed on Brighton Street, usually back out to
seek other means of ~ngress into the ar~a. A~ this l~ractice in~01ves hacking oat
almost blindly into a heavily traveled s~reet, an ext~emely hazardous situation is
created for the user~ of Rodman Ave.
In interest of brevity, only a few of our r~asons for requesting the prohibition of street
parking in the 3~00 block of Brighton S't. have been listed herein.

Since we, the undersigned, own ail of the property fronting or abutting on the 3800 block
of Brighton St. and sinbe the 3S0O block of ~righton St. lies entirely within the confines of a residential dis-
trier and, sznce we, as owners and occupants~ conside~the requested parking restrictions to be in the be~t ih -
55-260 - Motion of PLr. Smith to refer to the City Manager and City Attorney for s~udy,
the question of requiring garbage ~rinding units to be installed in' all buildings, in the.future, was adopted.
55-261 - The following letter from P.E. Wnukoski of the Westhaven Park Civic League, was
read:
"The Westhaven Park Civic League is quite concerned about the ~ayor's failure to rectify the erroneous ruling he
applied to the protested rezoning ~f lots 3,4,5 & 8 block 35, in the Westhaven Park area. Noreover, the League
is d~sturhed about the apparently doubtful value a~d meaning of city ordinances as instruments of municipal govern
ment. Since, on previous occasions, the ~ayor has been known to he quite meticulous in his adherence to s rigid
application of the City Co~e, the League finds it difficult to understand his present flagrant depar~urs from pre-.
scribed procedures. The League also finds it difficult to nnderst~ud why no eTEort has been made to rule on whe-
ther or not the petition wa~ properly si~ned and acknowledged. The validity of the siguatures was not questioned
when the petition was presented. The pezitioh ~s simply i~aored. In view of the apparent disparity between the
Nayor's ruling and the provisions contained in the applicable sections of the City and State Codes, the League
requests a clearly understandable and confo~ing ruling in re~"ard to this matter. I~ is understood that a conform-
ing ruling would ~ve the effect of declaring the pre~ious (Au~.g3rd) ruling to he in error and without force.
This failing, the League requests to he informed of the exact nature of the defects fonnd in the petition and what
critical effect did these defects have upon the intent and meaning of the petition as a whole. League representa-
tives will b~ in attendance al the-Oct, llthmeeting of Council to receive the above requestedminfo~ation."
