August 13th. 1957. Motion of Mr. Scott that refund be granted, was adopted. 57-284 - The following letter from Mrs. Joanna B, Lewis was read: "On Jdly 17th, 1957, I was given a traffic ticket, docket #59611, for making a le£t- hand turn from Washington St. on to High St. One'of the clerks at the traffic court advised me that if I appeared ~n court the fine would probably not be reduced, hut it would probably be no more. I paid the fine, which was $7.00J On the 23rd of July, the day before the date set for court, the traffic law was rescinded. The eases which appeared in court on 7-24-57 were dismissed and no fine was paid by any of these persons who were guilty of th~ same violation for which I was.given a ticket. On the basis of the abo~e, I am requesting that the $7.00 which I paid be refunded to me. Enclosed please find the recezpt which'will verify paymen~ of this." Mr. Kirby voting 'No'. 57-285 - M6tion of Mr. B~ker that the City Manager have a barricade placed on Colam-f bia St. at the A & D Railroad tracks, was adopted. resolution was adopted: 57-286 - Mr. Hinton presented the following resolution and, on his motion, said ~ WHEREAS, the fact that - Ther~ appeared, ~n the '~Portsmouth News' of .the Saturday, August 3, 1957, issue of "Tl~e ,Virginian Pilot', Norfol~.~ Portsm0u~, Va., page 7z~, an article by Charles Pritchard with headlines that stated "Library of Congress Concure, Bellamy again Confirmed as Author of Flag Pledge ." W-~EREAS, the aforesaid newspaper article sets forth ~herein the credit due Miss Margarette S. Miller, a graduate of WoodrQw Wilson High SchoOl, P~rtsmouth, Virginia, and a resident of PortsmoutH, Va., for the vgry important par~ played by her in establishing the authcrship of Th$. ~Pledge of Allegiance of being due ~o Prancis Bellamy, a native of Rome, New York; and ~g4EP~EAS, the sai~ Margarette S. ~ller has, since November Il, 1936, voluntarily and unselfishly, given of her ability, time and mea~s in research, which necessarily involved much time, travel, interviews and reading and study, in ~order to establish, to her satisfaction and beIief, the true authorship of safd Pledge of Alle~giance; and, WHEREAS, all through the yeavs o£ this work ~y the said Miss Margarette S. Miller, she kept on being urged to do so only by her high sense of fair play ~d patriotic duty and with no thought nor hope o£ any material ga£n personally, but only that credit of authorship be given to the one to whom it was due and ~rightfully belonged; and WHEREAS, the said Miss Margarette S. Miller,' in addition to the work of estab- lishing the authorship of the Pledge of Allegiance, wrote and published a book "~ Pledge A1- legzance , based upon the facts she had ascertained and instituted 'a "Bellamy Flag ~ward" at her own volition and expense, which fs stil~ continu~ed by her annually presenting, with proper ceremony, a U.S. Flag to some worthy Public High School, the recipien~ this year, 1957, being bhe ~ill Rogers High School, Tulsa, Oklahoma; therefore, BE IT RESOLVED, that this City Cquncil 0£ Portsmouth, ~irginia, as such, a~d on behalf of the residents of our City, whom we represent, do~s hereby rec'oguize, commend and congratulate the said Miss Margarette S. Miller qf Por. tsmou~h, Virginia, for all she has done in her worthy patriotic el.forts and service that a~e an example for all U.S. citizens, and finally, BE IT RE~0LIrED, that our Mayor, Hon. A.C. Bartlett, President of this City Coun- cil, be hereby requeste~ to in~ite th~ said Miss Mar~garette ~.. Miller to attend a public meet- ing of this City Council for presenting to her by His Honor, the i~ayor, for the City of Ports- mouth, Virginia, the original of these Resolutions,. and a copy 9f same be filed~with the offi- cia~ records of this Council of the City of Portsmouth, Virginia." 57-287- Motion of Mr. Ki~rby that the City Mauagor discuss with the State Highway DePartment the possibility of having route markers indichting the mileage to Portsmouth installed on the highways leading to Portsmouth~ was adopted. 57-288 - Motzon 9f Mr. Scott that tha City Manager be authorized~ to pay a salary of $10,000.00 annually' for a Director of Public Health, was adopted. '' To Andrew Briggs and ~y other owners thereof, the sum of One Hnndred and Fifty ~Dollars ($150.00) for the lot of land numbered 48 on the plat of the land of the I.~.~vey Estate, recorded in the~Clerk's. Office o£ the Cir- cuit court of Norfolk County in Map Book 3, page 66. To Giles Briggs, and any other owner thereof, the sum of One Hundred and Fifty Dollars ($150.00) for the lot of land numbered 49 on the plat of the I.O. Ivey Estate~ recorded i~ the Clerk's Office of the Circuit Court of Norfolk County in Map Book 3, page 86. : Be it further resolved in the event the above of£ers are not accepted, the City Attorney is authorized and instructed to institute condemnation iproceedings to .acquir~ ~he property for the purposes of theCity."
