<br />At a called meeting of the City Council, held on May 1st, 1958, there were present:
<br />
<br />A.C. Bartlett, B.W. Baker; W.E~ Hinton,-John E. Scott~ R. Irvine Smith,
<br />g.E. Weiseman,.I.G. Vass, City Manager~ and J.S. Livesay, City Attorney.
<br />
<br />The meeting was opened with prayer by ~r. Weiseman.
<br />
<br />The following call for the meeting was read:
<br />
<br />"Please attend a called meeting of the City Council at 4:30 P.M., on
<br />Thursday, May 1st, 1958, in the Council Chamber, re consider the peti-
<br />tion on the followlng ordinance:
<br />
<br />'AN ORDINANDE TO AMEND CHAPTER 8 OF THE CODE OF THE CITY OF
<br /> PORTSMOUTH, '1951, BY ADDING THERETO ARTICLE VIII, SECTIONS
<br /> 8-78, 8-79, 8-80, 8-81, 8-82, 8-83, 8-85, 8-86, 8-87, 8-88,
<br /> 8-89 and 8-90, P~LATING TO ASSESSMENT OF REAL ESTATE, PROVIDING
<br /> FOR AN ANNUAL ASSESSMENT OF REAL ESTATE, THE APPOINT~iENT OF A
<br /> SINGLE ASSESSOR, HIS DUTIES, ETC.'"

<br /> 58-144 A petition signed by John W. Boush, Jr., and others, filed with the City
<br />Clerk on the 22nd day of April, 1958, was presented, requesting the Council of the City of Portsmouth to cause
<br />to be submitted to a vote, the following question:
<br />
<br /> 'Shall the ordinance adopted by the Council of the City of
<br />Portsmouth on the 23rd day of October, 1956, providing for an
<br />annual assessment of real estate, 1the appointment of s single
<br />assessor, his duties, etc., be~repealed?t
<br />
<br />On motion of Mr. Hinton, the following~resolution 'was adopted and by the following vote:
<br />
<br /> Ayes: Bartlett, Baker, Hinton, Scott, Smith,Weiseman
<br /> Nays: None
<br />
<br />R solution
<br />
<br />Be it Resolved by the Council of the City of Portsmouth, Virginia,
<br />that there be submitted to a vote of the electors of the City of
<br />Portsmouth at the General Election to be held on the 10th day of
<br />June, 1958, the question set forth in the petition of John W.Boush,Jr.,
<br />and others, filed with the City Clerk on the 22nd day of April, 1958,
<br />namely:
<br />
<br /> 'Shall the ordinance adopted by the Council of the City of
<br />Portsmouth on the 23rd day of October, 1956, providing for an annual
<br />assessment of real estate, the appointment of a single assessor, his
<br />duties, etc., be repealed?'
<br />
<br />And be it further resolved that the Electoral Board of the City be
<br />and they are hereby directed to make the necessary arrangements for the
<br />election and take the sense of the qualified voters of the City on the
<br />question as set forth in said petition."
<br />
<br /> Mr. Baker's motion that the City Attorney seek declaratory judgment in the Court of
<br />Hustings ss to the validity of the 1958 land book after June lOth, 1958, was lost, there being no second.
<br />
<br /> Motion of Mr. Minton Shat the City Attorney be authorized to withdraw the suit in the
<br />Hustings Court on the original petition submitted, was adopted, and by the following vote:
