<br />attached for your £iles. You will observe that our former City Attorney was requested To give an opinion as to
<br />the legality of the City spending ta×payers' money for this purpose. We did not receive a reply to our request
<br />for an opinion prior to the retiremen~ of Mr. Barclay; therefore, this is a progress report presented for your
<br />information."

<br />On motion of M:c.:Smith, the 2ollowing resolution was adopted:

<br /> "WHEREAS, the United States Marine Corps' has declared to be surplus the
<br />land area and Improvements thereto kno~ as the Marine Forwarding Annex, Nansemond
<br />County, Vi2ginia, and
<br /> WHEREAS, it now seems probable that other branches of the Armed Forces
<br />of the United States may uot have need for th~ facilities mentioned, and
<br /> ~ItEREAS, the property might well lend itself ~o developmen~ as an in -
<br />dustrial area, with the creation of payrolls, employment, and all the beneficial ef -
<br />fects to our area economy usual to such development,
<br /> NOW, THEREFORE, BE IT RESOLVED, that the City Council of Portsmouth,
<br />Virginia, in regular meeting assembled on the eight~ day of July, 1958, does hereby
<br />urge the owner and any agency of the owner, To give £avorable consideration ~o the
<br />release of the property to soma local non-profit agency, ~o the end that the establish-
<br />ment of an industrial ares might be attempted,~ and
<br /> BE IT FURTHER RESOLVED that copies of this resolution be forwarded ~o the
<br />Nansemond Courtly Board o~ Supervisors, the Norfolk County Board of Supervisors, the
<br />Tidewater Virginia Development Council and the Regional Planning Commission."

<br /> 58-218 - "I am reporting the attached letter from~r. Frank D. Lawrence, offer-
<br />ing Evergreen Memorial Park to the City and I recommend that this matter he referred to the City Attorney for ~
<br />complete report on the legal status concerning the matter and if found favorable that the City accept the offer of
<br />the park ~o the Cit~."

<br /> Attached - "The Evergreen Memorial Park was established in 1935. The Evergreen Memorial Park
<br />Corporation, owners of the Park, being in a financial dilemma, appointed the writer, C.H. Snellings and Sol Fass as
<br />Trustee~s under a ~rust agreement dated December 31, 1939. Since that time the ~e~etery has been operated under the
<br />Trusteeship, Mr. A.G. Swe~t having succeeded Mr. Sol Fass a~ the latter's death in 1956.
<br /> The assets of the Trustees of Evergreen Memorial Park consist of approximately
<br />400 ~u~lsold lots, with an established price o£ $300°00, with at least 100 single graves at $50.00 each, plus the
<br />opportunity in the future of grave fees for about 8,000 more graves, there having been 557 burials in the Park up
<br />to date.
<br /> The Trustees would like to dedicate Evergreen Memorial Park to the City of Ports-
<br />mouth and suggest ~that the present city cemetery personnel could operate and maintain Evergreen Memorial Park with-
<br />out any additional cost to the City. Over ~ period of time the City would realize over $300,000.00 in addition to
<br />profit that could be realized on bronze markers, which should be another $100,000.0~, or a potential of over
<br />$400,000.00. Upon your acceptance of this offer, we will pxepaxe the proper Deed of ~edication."

<br /> Motion of Mr. Hinton to suspend the rules to hear from interested parties, was
<br />adopted.

<br />matter.
<br /> Motion o£ Mr. Baker to refer to the Cemetery Trustees and the City Attorney for
<br />investigation and report, was adopted~

<br /> .55-219 - "I recommend tha~ the City Manager be authorized and directed to offer
<br />for sale to the highest and best bidder all o£ that tract or parcel of land now owned by the City, generally known
<br />as the Ca~er Homes Housing Project Site and that the Conncil reserve the. right To reject any or a~l bids."
