At a regular meeting of the City Council, held on September 8th, 1959, there were <br /> <br />B.W. Baker, A.C. Bartlett, ~W.R.. Breedlove, R.B. Seward, R. Irvine Smith, <br />-GeorgD R. Walker, H. E. Weiseman, A.P. Johnson,J'~.-, City Manager, and <br />J.S, Livesay, Jr., City Attorney. <br /> <br />The meDting was opened with prayer by Mr. Smith. <br /> <br />The following reports from the City Manager were read: <br /> <br /> 59-230 - "Mr. Marion Tuttle, Business Representative of the Portsmouth City Employees <br />Local Union #733 has requested the privilege pf the floor. It is in order to. hear from him at this time." <br /> <br /> On motio~ of Mr. Bartlett, the question of arranging a conference with Mr. Turtle was <br />referred to the City Manager. <br /> <br /> 59-231 - "After a study and conference with the Portsmouth Transit Company officials, <br />the route of the Prentis Park bus line was re-routed by way of Lincoln Street rather than Elm Ave. This was done <br />also at the request of numerous citizens. <br /> <br /> Since this change has been made, the Transit Company has advised me that the <br />a~mber of riders has fallen Off on this line and thsy have had many, requests for it to be restored to the Elm <br />Ave. route. I have also received a petition requesting this change. It appears that the Lincoln St, service <br />is desirable on Sundays and the Transit Company has stated that it will provide this service if the route is <br />restored to Elm Ave. I recommend that this change he made,." <br /> <br /> Motion of Mr. Weiseman ~o concur in the Manager's recommendation was adopted, without <br />dissenting vote; this change to be on a ninety day trial basis. <br /> <br /> 59-232 - ~On July lOth, 1959, the City conveyed part of the old Jeffrey Wilson Home <br />site rd the Carlee Realty Corporation (Star Band Company). <br /> The deed contained an option to repurchase if the purchaser failed to con - <br />struct a building with 15.,000.square feet ~of floor space within~ ninezy days,._ The purchaser has complied with <br />this condition and has requested that the City give evidence of this fact by execution of a Quit Claim Deed. <br /> <br /> Upon advice of the City Attorney, .I recommend that the Mayor and City Clerk <br />be authorized to sign such s Quit Claim Deed." <br /> <br /> Motion of Mr. Breedlove to concur in the recommendation of the City Manager and that <br />the Mayor and City Clerk be suthoriz, ed to smgn the quit claim deed, was adopted~ without dissenting~vote. <br /> <br /> 59-~33 - "I am submitting herewith a copy of the preliminary Legislative Program of <br />the League of Virginia Municipalities to be presented at the convention at Old Point on September gist,t959. <br /> At the request of the League, this is submitted for your ~nformst~on. <br /> <br />On motion filed. <br /> <br /> 59-234 - "The next regular meeting of the City Council is scheduled for September 22nd <br /> 1959. At this time the majority of the members of the Council will be attending the Virginia League Comvention. <br />:I recommend that the Council meeting be changed to Tuesday September 29th, 1959." <br /> <br />without dissenting vote. <br /> <br />Mot;ion of Mr. Weiseman to :concnr in?the recommendation of the City Manager was adopte~ <br /> <br /> 59-235 - '~ttached hereto is a copy of a letter from the City Attorney with refer- <br />ence to quit claim deed fQr the Port Norfolk Schodt~ requested bY the School Board. <br /> This matter was referred to the City Attorney and me at the last Council <br />meeting. <br /> I concur in the recommendation of the City Attorney." <br /> <br /> "Pursuant-to the direction-of City Council, I-have endeavored to ascertain the title <br />status of the Port Norfolk School. This school building was taken into the City in the 1919 annexation. The <br />annexation order is silent as to transfer of title and a deed was not secured. The State law in effect at that <br />time also was silent as Ed transfer of title to school properties, although it speciiically _stated that money <br />awarded the County with respect to school properties was to go to the County School Board for construction of <br />school facilities. <br /> The situation with the Port Norfolk School is such that neither the City ~or the <br />School Board could dispo~eo!::it to~ the satisfaction ~f tit~e examine~s~ithout the other having quitclaimed its <br />interes~ in the proper~y. <br /> <br /> Since the state law covering sale:or t~ansfer or,school properties is more flexible <br />than our present char~er requirements, I recommend that the requested quitclaim deed be granted. This recommen- <br />dation is based in part on the recollection that the Council has conferred with the School Board regarding dis- <br />posal ~of. the ,~ro-p~r~ and concurs ,i~l~the plans of~ihe-School' Board.- CityAttorney." <br /> <br /> Motion Qf Mr. Breedlove to refer to a conference was adopted~w~t~:~e~issenting vote <br /> thee of Mr. Smith. <br /> 59-236 - "I have been investigating the possibility of establishing a boat ramp in <br />Portsmouth that would be suitable for the launching of the large, r type boats pulled by trailers. I find that <br />the property ownedby the Pennsy~wania Railroad Company ~ar t~.foo.t~of Chautauqu~-Ave~to'~e the most suit- <br />able for this ramp. I have corresponded with the Pennsylvania Railroad Company with reference to using this <br /> property for a boat ramp and enough land to provide for parking of automobiles and boat trailers. The Railroad <br /> Company is willing to lease the property on a thirty day tenancy at will basis for an annual rental of $665.00 <br /> which represents the actual taxes on the property. <br /> <br /> I reconunend that the City negotiate a lease on this property subject to <br /> the City having the right to advertise and lease the concession 'rights:to-the highest bidder." <br /> <br /> <br />
