Livesay,Jr., City <br />Attorney. <br /> <br />The following calls for the meeting were read: <br /> <br /> "You are requested to a~tend a called meeting of the C{ty Council, in the Council <br />Chamber, et 4:00 P.M., on Wednesday, November 4th, 1959, to consider an agreement between the Elizebeth <br />River Tunnel Co~mission and. the-City of Portsmouth. <br /> By Order of the President." <br /> <br /> "You are requested to attend a called meeting of the City Council, in the Council <br />Chamber, at .4:~5 P.~., on Wednesday, November 4th, 1959, - <br /> The purpose of this meeting is to consider an anlendment to the recent bond ordinance <br />&n order to provide an additional and local point of payment. <br /> <br /> Called at the request of Councilmen <br /> A.C. Bartlett, Raymond B. Seward and <br /> H.E. Weisenm~." <br /> <br /> Motion of Mr. Breedlove that the calls be merged and. that both items be considered <br />without adjournment, was adopted, without dissenting vote. <br /> <br />59-292 - The following resolution was read: <br /> <br />"A RESOLUTION APPROVING~HE PROVISIONS OF A CERTAIN AGREE~LENT BY AND <br /> BETWEEN THE ELIZABETH RIVER TUNNEL DISTRICT, THE CITY OF PORTSMOUTH, <br /> .THE COUNTY OF NORFOLK AND THE CITY OF NORFOLK, REk~TING TO THE ACCELERATION <br /> OF PAYMENT AND DISCHARGE OF CERTAIN OBLIGATIONS OF SAID DISTRICT UNDER <br /> CERTAIN CONTRACTS EXISTING BETWEEN IT AND SAID CITIES.AND COUNTY; AND <br /> AUTHORIZING THE EXECUTION, FOR AND ON BEHALF OF THE CITY OF PORTSMOUTH, OF <br /> SAID AGREEMENT <br /> <br />Be it Resolved by the Council of the City of:Portsmouth: <br /> <br /> Section 1 - That the provisxons of a certain agreement by and between the Elizabeth <br />River Tunnel District, the City of Portsmouth, the County of Norfolk and the City of Norfolk, relating to <br />the acceleretion of payment and discharge of certain obligetions of said District under certain contracts <br />existing between it and said Cities and County, copies of which said egreement, and of Exhibit. A therein <br />mentioned with its eddendnm are attached hereto, are hereby approved; and that the Mayor is hereby eutho- <br />rized to execute seid first mentioned agreement for en~ on behalf of the City of Portsmouth and the City Clerk <br />is hereby authorizDd to effix the corporate sea/ of the City of Portsmouth thereto and to attest the same. <br /> <br /> Section 2 - That upon the execution of the. eforeseid agreement,theLCity.Clerk-ahall <br />file copies thereof with the records of his office." <br /> <br />On motion of Mr Smith, the resolution was adopted, and by the followin~ vote: <br /> <br />Ayes: Beker, Bartlett, Breedlove, Smith, Walker, Weiseman <br />Nays: None <br /> <br />59-293 - The following ordinance was read: <br /> <br />"AN ORDINANCE PROVIDING THAT THE BANK OF VIRGINIA, PORTSMOUTH, VIRGINIA, <br />SHALL BE AN kDDITIONAL PAYING AGENT FO~ THE ISSUE OF SIX MILLION EIGHT <br />HUNDRED THOUSAND DOL~&RS OF GENERAL OBLIGATION BONDS AUTHORIZED BY AN <br />ORDINANCE ~DOPTED ON OCTOBER 13th, 1959" <br /> <br />_Mr. Bartlett moved the adoption of the ordinance. <br /> <br />On motion of Mr. Bartlett, the rules were suspended, to hear from interested persons. <br /> <br />The following spoke: <br /> <br />Frank D. Lawrence~representing the American National Bank <br />Maywood O. Lawrence, representing Citizens Trust Company <br /> <br /> Because of the opposition expressed by Messrs.Frank D.Lawrence and Maywood O.Lawrence, <br />end the se9ming objection of some members of the Council, Mr. B arttett requested the privilege of withdrawing <br />his motion, with the consent of his second, which p~ivil~ge was granted. <br /> <br />On motion adj~uFn~d, <br /> <br />.Approved - <br /> <br /> <br />
