Livesay,Jr., <br /> City Attorney. <br /> <br />The followin~ letter and call for the meeting were read: <br /> <br /> "CitylClerk - Will you please zssue a call for a special meeting of the <br />City Council, ~o be held in the Council Chamber at 2:30 P&M., o~ Monday, <br />February 15th, 19~0, ~o *co~sider a resolution opposing annexation legisla- <br />tion now pending in the Legislature?" Sig~ed - William R. Breedlove <br /> R. [trine Smith <br /> R.B. Seward." <br /> <br />"At the written request of Councilmen William R. Breedlove, R.Irvine Smith <br />and R.B. Seward~ a call for a special meeting of the City Council, in the <br />Council Chamber, ~t. ~:30 P.M,, on'~ouday, February 15th, 1960 is hereby issued, <br />to col~sider the adoption o~.'the following resolution: <br /> <br />'WHEREAS, there hame. been presented to the General Assembly certain <br />bills which would drastically altarthe existing, annexation laws of. <br />this State to-the end that annexatzons would ~irtually cease; and <br />WHEREAS, the cities of this State shouted not be .deprived ofltheir <br />right to g~Ow~h as bestowed.by Section. 126 of The Constitution of <br />Virginia, for the rsason that wi~ho~t~such growth.$h~ financial <br />ability of t~e cities to pgr£orm the~r'$ssential goverD-mental fu/lc- <br />tions would be impaired add destroyed. <br /> NOW, THEREFORE, BE IT RESOLVED. by.~h~ Council of the City of Ports- <br />month, Virginia,.thSt the sense of this Cou3acil be and hereby is <br />declared as opposing any alteration of the general, annexation laws of. <br />the State.at this time. <br /> BE IT FUHTHEE RESOLVED that certified copies of this resolution be <br />Iorwarded to the elected representatives of the City of Portsmouth now <br />serving in .the Geaeral~AsseEzhly and .to the Chairmen of the Committees <br />on Comities, Cities and Towns of the House of Delegates and Senate of <br />Virginia.'"~ <br /> <br />Motion of~r. Breedlove that the resolution in the call be adopted. <br /> <br /> Mr. Walker read a statement and requested, as a point of personal privilege, thathis <br />dissenting opinion be attached.to copies of the resolution which are to be forwarded ~o our Representatives ~n <br />Richmond. <br /> <br /> After discussion, the Chair denied the point of personal privilege. <br /> <br /> ~otion of Mr. Walker that his ce~nts be included as an addenda to the resolution, <br />was lost, the~e being ne second. <br /> <br /> Motion of Mr. Walker that the resolution be ameuded by changing :the second paragraph <br />to eliminate the wording .following the word 'Virginia' and substituting 'for the reason that the normal growth <br />of cities would be impaired a~d destroyed' was lost, there being no-second. <br /> <br />Vote being;taken, Mr. Breedlgve's motion was adopted, and by the following vote: <br /> <br />Ayes: Baker, Bartlett, Breedlove, Seward, Smith <br />Nays: Walker <br /> <br />On motion, adjourned. <br /> <br />City Clerk <br /> <br />Approved - <br /> <br /> <br />
