At a called meeting of the City Council, held on December 5th, 1961, there were present: <br /> <br />R. Irvine Smith, <br />George R. Walker, <br />Attorney. <br /> <br />C. S. Atkin~n, Jack P. Livesay, Jr., City <br /> <br />The meeting was opened with prayer by Mr. Smith. <br /> <br />61-330- The following 'waiver' signed by Councilman Weiseman was read: <br /> <br /> "On advice of my personal physician and in keeping with the express wishes of my fellow <br />members of the City Council, it will not be possible for ~ to attend special called meetings of City Council, <br />should any be called between now and January 1, 1962. <br /> Therefore, I waive the giving of notice to me of the calling of any such meeting and <br />the subject matter thereof between this date and January 1, 1962. <br /> <br />61-331- The following call forlthe meeting was read: <br /> <br /> "Please attend a called meeting of the City Council, at 7:30 P.M., Tuesday, December 5th,~ <br />1961, at the Council Chamber, to consider on first reading the following ordinance: <br /> <br />'AN ORDINANCE TO PETITION THE CIRCUIT COURT OF NORFOLK COUNTY, VIRGINIA, <br />PURSUAlqT TO THE PROVISIONS ~F CHAPTER 8 OF TITLE 15 OF THE CODE OF VIRGINIA, <br />1950, AS AMENDED, FOR THE ANNEXATION OF CERTAI~ TERRITORIES LYING IN NORFOLK <br />COIFNTY~ VIRGINIA, ADJACENT TO THE CITY OF PORTSMOUTH, VIRGINIA; TO SET FORTH <br />THE NECESSITY FOR AND EXPEDIENCY OF SUCH ANNEXATION AND THE METES AIND BOUNDS <br />AND SIZE OF SUCH TERRITORIES; TO INDICATE GENERALLY THE SUBDIVISIONS, INDUS- <br />TRIAL AREAS, ~AltMAREAS, VACANT AREAS AND OTHER AREAS SOUGHT TO BE ANlkrEXED, <br />TOGETHER WITH OTHER INFORMATION DEEMED RELEVANT AS TO POSSIBLE FUTURE USES OF <br />THE PROPERTY WITHIN THE AREAS; TO STATE GENERALLY THE TERMS AND CONDITIONS <br />UPON WHICH ANNEXATION IS SOUGHT, AND THE PROVISIONS PLANNED FOR THEVFUTUP~E <br />IMPROVEMENT OF THE ANNEXED TERRITORIES~ INCLUDING THE PROVISION OF PUBLIC <br />UTILITIES AND SERVICES THEREIN; AND TO AUTHORIZE THE INSTITUTION AND CONDUCTING <br />OF THE NECESSARY LEGAL PROCEEDINGS TO EFFECTUATE SAID ANNEXATION.' <br /> By Order of the President." <br /> <br />61-332 - The following report from the City Manager was read: <br /> <br /> "After a thorough study by our Consulting Engineers, and upon their recon~mendation, I <br />submit the attached ordinance. This ordinance authorizes the City to proceed with an annexation suit for portion~ <br />of Norfolk County to be incorporated in the City of Portsmouth. <br /> I recommend that this ordinance be placed on first reading." <br /> <br />Motion of Mr. Barnes to approve the following ordinance on first reading: <br /> <br />"AN ORDINANCE TO PETITION THE CIRCUIT COURT OF NORFOLK COUNTY, VIRGINIA, <br />PURSUANT TO THE PROVISIONS OF CHAPTER 8 OF TITLE 15 OF THE CODE OF VIRGINIA, <br />1950, AS AMENDED, FOR THE ANNEXA-TION OF CERTAIN TERRITORIES LYING IN NORFOLK <br />COUNTY, VIRGINIA, ADJACENT TO THE CITY OF PORTSMOUTH, VIRGINIA; TO SET FORTH <br />THE NECESSITY FOR AND EXPEDIENCY OF SUCH ANN~TION AND THE METES AND BOUNDS <br />AND SIZE OF SUCH TERRITORIES; TO INDIC~ITE GENERALLY THE SUBDIVISIONS, INDUS- <br />TRIAL AREAS, FARM AREAS, VACANT AREAS AND OTHER AREAS SOUGHT TO BE AiRqEXED, <br />TOGETHER WITH OT~J~R INFORMATION DEEMED RELEVANT AS TO POSSIBLE FUTURE USES OF <br />THE PROPERTY WITHIN THE AREAS; TO STATE GENERALLY THE TERMS AND CONDITIONS <br /> UPON WItIGH ANNEXATION IS SOUGHT, AND THE PROVISIONS PLANNED FOR THE FUTURE <br /> IMPROVEMENT OF THE ANNEXED TERRITORIES, INCLUDING THE PROVISION OF PUBLIC <br /> UTILITIES AND SERVICES THEREIN; AND TO AUTHORIZE THE INSTITUTION AND ~ONDUCTING <br /> OF THE NECESSARY LEGAL PROCEEDINGS TO EFFECTUATE SAID ANNEXATION" <br /> <br />The following motion of Mr. Walker was lost, there being no second: <br /> <br />"I move the following substitute motion - that Council approve a resolution of invi- <br /> <br />ration, as follows: <br /> <br />'WHEREAS, in recent weeks there has erupted a rash of annexation and merger threats, <br />charges and countercharges, and statements revealing deep fears and evidence of <br />lack of faith, and <br /> WHEREAS, such actions have been the result of political pressures and maneuvers <br />and not the product of normal growth, and <br /> WHEREAS, if allowed to run its course, the abovesaid political disease will <br />cause great damage to the industrial and community image of the Tidewater area <br />and incur great and unnecesssgry expenditures of public funds to the benefit <br />of no one except those professionals hired to %ngineer, prosecute and defend the suit <br />and <br /> WHEREAS,~H~ people, under our form of government of, by, and for, have not been <br />provided with sufficient facts, or time, to enable them to compose and register <br />their~iews, <br /> THEREFORE, BE IT RESOLVED, that the Council of the City of Portsmouth, Virginia, <br />extends to the governing bodies of the Cities of Norfolk, South Norfolk and Virgi- <br />nia Beach, an urgent invitation to jointly sponsor one, or more seminars for the <br />pose of airing and discussing publicly the views, needs and desires of each, and <br />with the express goal of reducing fears and distruct, separating real needs from <br />those of political expediency, and reaching, wherever possible, a negotiated arrange- <br /> <br /> <br />
