At a regular meeting of the City Council~ held on March 27th, 1962, there were present: R. Irvine Smith~ C. S. Atkinson, Jack P Barnes~ John L. Dillon, L. L. Knight, W T Leery, George R. Walker, A~P. Johnson,Jr., City Manager, and J.P. Livesay,Jr., City Attorney. The meeting was opened with prayer by Mr Atkinson. Minutes of regular meeting held on March 13th, 1962 and called meeting of March 21st, 1962 were read and approved. 62-63 - The following hearing on zoning changes was held. 6-62 - Petition of Portsmouth Industrial Foundation, Inc. (Tract A and Tract W.F.Brooks spoke in favor of the petition. Motion of Mr. Barnes to concur in the recormnendation of the Planning Commission and to place the following ordinances on first reading was adopted, without dissenting vote: "ZONING AMENDMENT ORDINANCE 19~62-~' "ZONING AMENDMENT ORDINANCE 1962-B" 7-62 - Petition of Mrs. Mary L. Eaton and Mrs. Mary E. Todd. No one spoke in regard no the petition. Cormnission to deny Motion of Mr. Barnes to concur in the recommendation of the Planning this petition was adopted, without dissenting vote. 3-62 - Petition of the City of Portsmouth and M_rs. Ethel D. Saunders. No one spoke in regard to the Use Permit. ~otion of Mr~ Leery to concur in the recommendation of the Planning Cor~Jssion and to ~doph the following resolution was adopted, without dissenting vote: "WHE1LEAS, the City of Portsmouth, by its City Attorney, has filed an application pursuant to Section 4-2 of the Zoning Ordinance of the City o~ Portsmouth, 1961, for the granting of a Use Permit as hereinafter described; and WI{EREAS, the applicant, the Planning Director and ~he City Manager have done all things required no be done in connec- tion with said application, and the Planning Commission has recommended the granting o~ said ~se permit, NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: A. That the use for which the use permit hereinafter described is sought (1) will not adversely affect the health o~ safety of persons residing or working in the neighborhood of the proposed use, (2) will not be detrimental to the public welfare or injurious to pro- perty or improvements in the neighborhood, and (3) will be in accord with the purposes of said Zoning Ordinance. B. That the City of Portsmouth is hereby granted a use permit, pursuant to Section 4-2 of said Zoning Ordinance, for the construction and operation of a sewer pumping station to be located on the northeastern s~enty=five (75) feet of Lot 80~ as shown on the plat of '~ine Acres Replat" Map Book 39, page 85, Norfolk County Circuit Court, said property to be purchased from Ethel D.
