<br />At a called meeting of the City Council, held on August 4, 1964, there were present:
<br />
<br />R. Irv~ne Smith, C. S, Atkins~n, Jack P. Barnes, John L. Dillon, George D. Eastes, W. T. Leafy,
<br />A. P. Johnson, Jr.., City Manager, aud M. A. Korb, Jr., City Attorney.
<br />
<br />The meeting, was opened by prayer by Mr. Smith.
<br />
<br />The following ~all for the meeting was read.:

<br /> "You are requested to attend acalied meeting ~ the City Council, in the Council Chamber, at 7:30
<br />P.M., on Tuesday, August 4th~ 1964, to consider a con~unication from George R. Walker, dated on June 19th, 1964,
<br />regarding the Councilmanic General Election, held in Portsmouth, on $~e 9th, 1964." ·

<br /> 64-194 -The Chair announced th~ the public hearing on letter from George R. Walker, addressed to the
<br />~iSy Council dated June 9th, ~964,~.would ~e held at this.time.-: .....

<br /> Mr. Walker..~linfi. d:~c~$peak unless a formal hearing was held, in whic~ th~ personspeaking on the
<br />matter would be plaqed u~dcr oath. CiSy AStorney KOrN, when asked, .stated that this is ~ proper hearing an~ %t
<br />would no~ be necessary fer witnesses to be sworn in.
<br /> David Lindauer, representing the Electoral Board, spoke and presented the following letter from
<br />Levin Nock Davis, Secretary, State Board of Elections;
<br />
<br /> '~ur~g telephone conversation had with you today you asked me4f we.received the correct number
<br />of ballots from the City of Portsmouth which we requested to be used by persons zn the active service of the
<br />armed forces who might apply for..same.. I t01d you we di~ and yyou t~en asked =me if I would confirm this to you in
<br />writing. . _
<br /> You are advised tha~ this office recieved on hundred ballots from the port~mouth Electoral Board
<br />on NPay 7, 1964, for the June 9, 1964; ~unic~pal Election. A number of the ballots were.sent to members of 'the
<br />armed forces who made ~pplica~ion ~to this office foe same~ This is usual and in accordance ~lth the law.
<br /> For your.information, we also received a copy of the official abstract of vo~es from M~. Cecil ~.
<br />Johnson, C%erk of th.e Hustings. Court fo~ the Cit~ o~ PortSmouth, showing the~votes cast for each candidate and the
<br />names of the successful candidntes for City:Council.
<br /> Trus~ing this g~ve~ you the information.you desire."

<br /> Mr. Lin~auer stated that the Electoral Board had complied with the law except that the Board had
<br />given verbst rather than written nobice as required by SeCtion 24-300.
<br />
<br /> Mr. Walker, in his rebuttal, again protested the procedure of the meeting and renewed the charges
<br />in his letter of 4une 19th, 1964.
<br />
<br />The Chair asked if there were others who wo~ld.like to speak. No one responded.
<br />
<br />The Chair declared the hearing had been concluded and fha% the Council was back in session.

<br /> Motion of Mr. Eastes that the Council approve the conduct of the Electoral Board in the Councilmanic
<br />election held on June 9th, 1964, was adop!~: wi. thout-dissen$ing~o~e.
