July 28. 1998 <br /> <br />(d) Will be a project that will be developed according to a plan <br />for parking, driveways, and curb cuts which will provide for safe <br />and convenient traffic movement; and <br /> <br />(e) Will be in accordance with the purposes of the City of <br />Portsmouth Zoning Ordinance. <br /> <br />That L. Louise Lucas is hereby granted a use permit pursuant to <br />Section 40-43.1 of the Code of the City of Portsmouth, Virginia <br />(1988) for the operation of an adult assisted living facility (S.I.C. <br />8059) on property located at 1819-1827 Elm Avenue, and being more <br />particularly described as: <br /> <br />UP-98-06 <br /> <br />Beginning at the northeast corner of the intersection of Elm <br />Avenue and Lincoln Street; thence, north 175'+ to a point; <br />thence, east 100'+ to a point; thence, south 175'+ to a point; west <br />100'+ to the point of the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) The facility shall operate as a residential housing facility <br />providing services for not more than twenty-four persons, 22 years of <br />age or older, who are developmentally disabled or mentally retarded. <br /> <br />(b) The facility shall provide eight (8) off-street parking spaces <br />meeting all applicable code requirements. <br /> <br />(c) The facility shall be limited to ambulatory residents able to exit <br />the building without assistance in the event of an emergency. <br /> <br />(d) The facility shall not be utilized for any drug rehabilitation or <br />temporary "halfway house" program. <br /> <br />(e) The residents' participation in outdoor activities or being allowed <br />to leave the site unescorted shall be limited to daylight hours. <br /> <br />(f) At no time shall drugs, other than those medically prescribed, or <br />alcoholic beverages be allowed at the facility. <br /> <br />(g) The facility shall submit to all required inspections by state and <br />local agencies. <br /> <br />(h) The structure shall be constructed in accordance with the <br />attached Building Elevation (Exhibit B) and the attached Site Plan <br />(Exhibit A). <br /> <br />(i) The site on which the facility is constructed shall be screened <br />with 6' chain link fencing along the north side and rear property line <br />and with 4' chain link fencing on the south side in accordance with the <br />requirements of the Zoning Ordinance. Red tip photinias shall be <br />planted at five-foot intervals inside the fencing. <br /> <br />(j) The applicant Shall comply with all applicable codes, ordinances <br />and regulations of federal, state and local governments and shall obtain <br />all necessary licenses and permits. <br /> <br /> <br />
