February 275 1968 <br /> <br />ARTICLE III. DOGS GENERALLY <br /> <br />Sec. 5-14. Leash or muzzle required when running at large. <br /> <br /> It shall be unlawful for the owner of any dog to allow such dog on any public street, alley or <br />squgme of the city, unless such dog is accompanied by an attendant, held leash by a responsible person or sec <br />muzzled with a muzzle, the character of which shall have been approved by the game warden. <br /> The law at present is also unfair to the dog itself. A muzzled dog is defenseless when attacked. <br /> At this time I wish to submit for adoption a leash law stating that the animal be: <br /> 1. Tied <br /> 2. Fenced <br /> S. Walked on a leash <br /> <br />The enforcement be such that: <br />1. First offense-- $5.00 fine and warning <br />2. Second offense-- $15.00 fine and final warning <br />5. Third offense-- The dog is permanently removed from its owner." <br /> <br /> Motion of Mr. Johnson that the matter be referred tc the City Attorney to-.prepare a new <br />ordinance pertaining to this subject, was adopted, without dissenting vote. <br /> <br /> 68-66 - A list of delinquent city real estate taxes for the year 1967 was submitted by Margaret <br />Jones, Chief Deputy in the City Treasurer's Office. <br /> <br /> Motion of Mr, Knight that it be received and reviewed by the entire citM council as soon as <br />possible, was adopted, without dissenting vote. <br /> <br /> 68-68 - The following letter from Judge Major M. Hillard of the Circuit Court of Chesapeake, <br />was read, and on motion of Mr. Ea~tes referred to the file on applications for Justice of the Peace: <br /> <br /> "%Vhen the territory formerly Western Branch Borough of the City of Chesapeake was apart of the <br />City of Chesapeake, I appointed aa Justice of the Peace, a man named ~illiam C. Phelps, who <br />served as a Justice of the Peace for the Western Branch Borough and served very well. <br /> Mr, Phelps is a young man of excellent reputation and has a lot of friends in that area and <br />is fully qualified to act as a Justice of the Peace. <br /> Inasmuch as he is now a resident of the City of Portsmouth and informs me that he is going <br />to resign as Justice of the Peace for the City of Chesapeake~'I do not hesitate to recommend him <br />for a similar position in the City of Portsmouth." <br /> <br /> 68-69 - The request of Sidney A. Warren for permission to be heard, in regard to a hardship <br />case concerning a lot he owns in the City, was read: <br /> <br /> "It is my desire to come before the Council of the City of Portsmouth ~ith what I consider an extreme <br />hardship case concerning aglot that I own in the City. <br /> I trust that this can be arranged." <br /> <br />On motion of Mr. Barnes, the rules were sqspended to hear Mr. Warren. <br /> <br /> Mr. Warren was not present. The Cie~k was requested to contact him and inform him that he could <br />be heard at the next meeting of the Council. <br /> <br />68-70 -Motion of Mr. Johnson that the traffic pattern on County Street from Washington to Crawford be <br /> changed i~mediately to allow o~e hour parking on the south side of County Street, was adopted, without <br /> dissenting vote. <br /> <br />On~ motion adjourned. <br /> <br />APPROVED <br /> <br />President <br /> <br />City Clerk <br /> <br />lrely <br /> <br /> <br />
