On motion of Mr. King, resolution adopted, without dissenting vote. <br /> <br /> 68-197 - "I submit the attached agreement between the Seaboard Coast Line Railroad Company and the City <br />of Portsmouth and reco~end the proper City officials be authorized to sign. This is for a water line cross- <br />ing ander the tracks of the Seaboard Coast Line Railroad on its Pig Point branch. This water line is being <br />installed to serve the Rivershore area of the City and is being constructed down Twin Pines Road." <br /> <br /> Motion of Mr. Hastes that the proper city official be authorized to sign the agreement, was adopted, with- <br />out dissenting vote: <br /> <br /> 68-198 - "AT the last meeting of the City Council, a oetition was presented requesting the City to make <br />application to the local district engineer of the Corps of Hngineers for a feasibility study for the dredging <br />of a channel in Stem's Creek. <br /> <br /> The Corps of Engineers can make these feasibility studies under the authority of Section 107 of the 1960 <br />River and Harbor Act. The feasibility study would be made at the expense of the Federal Government, and any <br />dredging or navigational improvements would be on a 50-50 basis with the City. <br /> <br /> There are, however, certain requirements that the City must agteet~o which we could not meet in the <br />dredging of Stem's Creek. The regulations require that the City must provide, maintain and operate with- <br />out cost to the United States an adequate public landinggor wharf with provisions for the sale of motor fuel, <br />lubricants and potable water, open and available to the use of all on equal terms. It further requires <br />that the City provide and maintain berthing areas, floats, piers, slips and similar marina and morring facil- <br />ities as needed for transient and local vessels as well as necessary access roads, parking areas and other <br />needed public use shore facilities open and available to all on equal terms. <br /> <br /> Section 426H of the United States Code further stipulates "Shores other than public will be eligible <br />for Federal assistance if there is benefit such as that arising from public use or from the pmmtection of <br />nearby public property, or if the benefits to these shores are incidental to the project and the Federal <br />contribution to the project shall be adjusted in accordance with the degree of such benefits'~. This means <br />that Federal funds would be reduced by the amount that any benefits that would accrue to private property <br />with these improvements. <br /> <br /> ~]is matter has been researched thoroughly by the City Attorney, and myself, and as there is no public <br />land on Stem's Creek, we do not believe that the dredging of this creek could quality under this program." <br /> <br /> Motion of Mr. Knight that the report be received and that the applicantfor dredging be advised accordingl] <br />was adopted without dissenting vote. <br /> <br /> <br />
