This authorizes the issuance <br />of $I,000,000 of Utility Revenue Bonds. ~se funds are to be Used for the construction of sanitary severs <br />in the areas of the City that are without sewers. <br /> <br />This is a portion of the $2,500,~00 authorized by a referendum at the election on November 5, 1968." <br /> <br />On motion of Mr. Turner, the ollow~ng resolution was adopted, and by the following vote: <br /> <br />"A RESOLUTION TO AUTHORIZE THE ISSU;~CE OF ONE MILLION DOLLARS OF BONDS TO BE KNOPlN AS UTILITY <br />BONDS FOR THE PURPOSE OF MAKING IMPROVE~TS, EXTP3{SIONS AND ADDITIONS TO THE R~VHNUE PRODUCING <br />UNDERTAKING OF THE CITY CSNSIST1NG OF ITS WATER, SES~ER, AND SEWAGE DISPOSAL SYSTEMS, PURSUANT <br />TO SECTION 127, CLAUSE {B}, OF THE CONSTITUTION OF VIRGINIA, AND CHAPTER 5 OF TITLE 15.10FTHE <br />CODE OF VIRGINIA, 1950, AND UNDER AUTHORITY OF TNE VOTE OF THE ~UALIFIED VOTERS OF THE CITY OF <br />PORTSMOUTH AT AN ELECTION MELD ON T~t~ FIFTH DAY OF NOVEMBER, 1968, AND MAKING PROVISIONS NOR THE <br />FORM OF SAID BONDS AND FOR THE PAY~t~T THEREFOR. <br /> <br /> ~'~4HREAS, the City of Portsmouth is authorized to establish or enlarge its revenue ~roducing undertaking <br />consisting of its water, sewer, and sewage disposal systems, and under and by virtue o~ Chapter 5 of Title <br />15.1 of the Code of Virginia, 195~, the Council of any City in this State which is authorized to acquire, <br />maintain or establish a revenue producing undertaking consisting of water, sewer, and sewage disposal systems, <br />or other specific undertaking from which the City may derive a revenue, may in accordance with Section One <br />Hundred and Twenty-seven, clause (b} of the Constitution of Virginia, issue somany bonds as may be necessa~M <br />to acquire, maintain or establish such revenue producing undertaking, or other specific undertaking; and <br /> <br /> }CHER~AS, it is necessary and expedient to make certain improvements, extensions and additions to suck reve- <br />nue producing undertaking consisting of the water, sewer, and s~Se disposal systems of the City of Portsmouth <br />and to borrow for that purpese the sum of 0ne Million Dollars and to issue bonds therefor; and <br /> <br /> I%'HEREAS, Section One I~hndred and Twenty-seven, clause lb), of the Constitution of Virginia, requires the <br />ordinance authorizing the issuance of such 5ondsto be approved by the affirmative vote of the majority of the <br />qualified voters of the City voting upon the question of their issuance at the general election next succeeding <br />the enactment of the ordinance, or at a special election held for that purpose; now therefore; <br /> <br /> }~REAS, by virtue of an ordinance adopted by the Council of the City of Portsmouth~on the eighth day of <br />October, 1968, entitled, "An Ordinance to Authorize the Issuance of Two Million ~ive Hundred Thou~and Dollars <br />of Bonds to be Known as Utility Bonds, for the Purpose of Making Improvements, ~xtensions and Additions to the <br />revenue producing undertaking of the City, consisting of its water, sewer, and sewage disposal systems, pur- <br />suant to Section One Hundred and Twenty-seven, Clause (B}, of the Constitution of Virginia, and Chapter 5 of <br />Title 15.1 of the Code of Virginia, 1950", t~e Court of Hustings for the City of Portsmouth, by an order entered <br />on the eleventh day of ~ctober, 1968, directed that there be submitted to the qualified voters of the City of <br />Portsmouth at am election to be held on the fifth' day of November, 1968, the question whether the~bonds <br />authorized by the said ordinance should be issued; and <br /> <br /> IfliERHAS, by another order entered by the said Court on the twenty-second day o£ November, 1968, it was <br />entered of record as a result of said election that a majority of the votes were cast f~r the bond issue, and <br />that t~ Council of the City of Portsmouth he fully authorized and empowered to orepare and issue and to sell <br />or to negotiate said bonds upon the f~ith, credit and property of said municipality in the amount so authorized <br />and <br /> <br /> <br />
