September 22. 1998 UP-98-10 Beginning at a point 659'+ east of the intersection of Victory Boulevard and Beazley Drive; thence, north 208 '+ to a point; thence, east 183'+ to a point; thence, in a southwesterly direction 208'+ to a point; thence, west 210'+ to the point of the beginning. 3. That this use permit is approved subject to the following conditions: (a) Occupancy of the facility shall be limited to fifty children, 2-1/2 years of sage and older. (b) The project shall be developed in accordance with the submitted site plan, identified as Exhibit A, a copy of which is attached hereto and made a part hereof. (c) Outdoor activities shall be limited to between the hours of 8 A.M. and 6:00 P.M. (d) Indoor hours of operation shall be limited to between the hours of 6:00 A.M. and 6:00 P.M. Monday through Sunday. (e) The facility shall annually request an inspection by the Fire Department, the Public Health Department and the Building Official and shall correct any noted deficiencies. (f) The facility shaU comply with all applicable federal, state, and local codes, ordinances and regulations of federal, state and local governments, and shall obtain and shall maintain in effect all necessary licenses and permits. (g) All taxes and fees shall be paid when due. 4. REVOCATION OF PERMIT: Violation of any of the above conditions may serve as grounds for revocation of the use permit by the City Council." 98-216(c): "RESOLUTION GRANTING A USE PERMIT TO VENISHA DORAN FOR THE OPERATION OF A CHILD DAY CARE FACILITY AT 1603 HIGHLAND AVENUE. WHEREAS, Venisha Doran has made application pursuant to Section 40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting of a use permit to operate a child day care facility to be located at 1603 Highland Avenue, Portsmouth, Virginia, as hereinafter-described; and WHEREAS, the applicant and the Planning DireCtor have done all things required to be done in connection with said application; and WHEREAS, the Planning Commission has recommended the granting of said use permit with conditions. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: 1. That the use for which the permit hereinafter-described is sought: (a) Will not adversely affect the health and safety of persons residing or working in the neighborhood of the proposed use;
