September 22. 1998 <br />UP-98-10 <br /> <br /> Beginning at a point 659'+ east of the intersection of Victory Boulevard <br />and Beazley Drive; thence, north 208 '+ to a point; thence, east 183'+ to a <br />point; thence, in a southwesterly direction 208'+ to a point; thence, west 210'+ <br />to the point of the beginning. <br /> <br />3. That this use permit is approved subject to the following conditions: <br /> <br />(a) Occupancy of the facility shall be limited to fifty children, 2-1/2 <br />years of sage and older. <br /> <br />(b) The project shall be developed in accordance with the submitted <br />site plan, identified as Exhibit A, a copy of which is attached hereto <br />and made a part hereof. <br /> <br />(c) Outdoor activities shall be limited to between the hours of 8 A.M. <br />and 6:00 P.M. <br /> <br />(d) Indoor hours of operation shall be limited to between the hours <br />of 6:00 A.M. and 6:00 P.M. Monday through Sunday. <br /> <br />(e) The facility shall annually request an inspection by the Fire <br />Department, the Public Health Department and the Building Official <br />and shall correct any noted deficiencies. <br /> <br />(f) The facility shaU comply with all applicable federal, state, and <br />local codes, ordinances and regulations of federal, state and local <br />governments, and shall obtain and shall maintain in effect all <br />necessary licenses and permits. <br /> <br />(g) All taxes and fees shall be paid when due. <br /> <br /> 4. REVOCATION OF PERMIT: Violation of any of the above <br />conditions may serve as grounds for revocation of the use permit by the City <br />Council." <br /> <br />98-216(c): <br /> <br /> "RESOLUTION GRANTING A USE PERMIT TO VENISHA DORAN FOR <br />THE OPERATION OF A CHILD DAY CARE FACILITY AT 1603 HIGHLAND <br />AVENUE. <br /> <br /> WHEREAS, Venisha Doran has made application pursuant to Section <br />40-43.1 of the Code of the City of Portsmouth, Virginia (1988) for the granting <br />of a use permit to operate a child day care facility to be located at 1603 <br />Highland Avenue, Portsmouth, Virginia, as hereinafter-described; and <br /> <br /> WHEREAS, the applicant and the Planning DireCtor have done all <br />things required to be done in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has recommended the <br />granting of said use permit with conditions. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of <br />Portsmouth, Virginia: <br /> <br /> 1. That the use for which the permit hereinafter-described is sought: <br /> <br />(a) Will not adversely affect the health and safety of persons residing <br />or working in the neighborhood of the proposed use; <br /> <br /> <br />
