December 9~ 1969 <br /> <br />9.04. Juvenile and Domestic Relations Court. <br /> <br /> There shall be a juvenile and domestic relations court for the city. Such court <br />shall possess the same jurisdiction and powers as are conferred by law upon juvenile and <br />domestic relations courts of cities of the first class. <br /> <br />§ 9.05. Judges of the Juvenile and Domestic Relations Court. <br /> <br /> The judge, associate judges and substitute Judges of the juvenile and domestic <br />relations court shall be appointed for four-year terms by the judge of the court of hustings <br />for the City of Portsmouth. Appointments to vacancies shall be for the unexpired term. <br />The terms of all associate judges and substitute judges shall be coterminous with the / <br />term of the judge of said court. The term o~ the Judge of the juvenile and domestic relation <br />cour~ in office on the effective date of this act shall expire on July l, 1970; his successo~ <br />shall be appointed for a four-year term commencing on July l, 1970. All appointments ~ <br />hereunder shall be subject to the approval of a majority of all the members of the city <br />council. <br /> <br />§ 9.06. Assignment of Work. <br /> <br /> The judge of the jmvenile and domestic relations court may assign the work of <br />said court, in his sole discretion, betw~ himself and such associate judges as may be <br />appointed, in order to eGmalize the work load of such Judges. <br /> <br />§ 9.07. Judges of Courts Not of Record. <br /> <br /> Any Judge, associate judge or substitute judge of any court not of record located <br />within the City of Portsmouth may act as the judge of any other court not of record located <br />within the City of Portsmouth and while so acting, he shall perform the same duties, exercise <br />the same power and authority, and be subject to the same obligations as prescribed by <br />law for the judge of such court. <br /> <br />§ 9.08. Justices of the Peace. <br /> <br /> There shall be appointed by ~he judge of the ma~ri~y.of all the members of the <br />City Council ten justices of the peace for the city at large who shall hold office for a <br />term of four years and until their successors are elected and qualified. The terms of the <br />jdstices of the peace in office on the effective date of this act shall expire on January l, <br />1975; their succes'sors sh~ll be appointed for four year terms commencing on January 1, 1973. <br />The judge of the municipal court shall exercise general supervision and administrative power <br />over the Justices of the peace. This sh&ll include the power to regulate the time and place <br />of sitting such justices of the peace. The judge of the municipal court shall designate one <br />of the justices of the peace as the chief justice of the peace who shall have suc4 additional <br />duties as the council may prescribe. Appointments made under the provisions of this section <br />shall be revokable at the pleasure of the majority of members of the City Council. <br /> <br />§ 10.01, <br /> <br /> Initiative, <br />Petition for Initiative. <br /> <br />(a) Any proposed ordinance, <br /> <br />ARTICLE X <br /> <br />Referendum and Recall <br /> <br />including any ordinance for the repeal or amendment <br /> <br />of an existing ordinance may be submitted to the council by petition signed by at least <br />thirty per centum of the electors eligible to vote in the last preceding general election. <br />Such petition shall contain the proposed ordinance in full. <br /> <br />(b) The petition shall be substantially in the following form: <br /> <br /> To the Council of the City of Portsmouth, Virginia: <br /> <br /> We, the undersigned, qualified electors of this city, <br />honorable, body to ordain the following ordinance: <br /> <br /> Signature of Elector Street Address <br /> <br />respectfully petition your <br /> <br />Date Signed <br /> <br /> (c) The execution of the petition by an elector shall be acknowledged by him, <br />or it may be proved by the oath of a witness who shall swear that he knows the elector <br />and that the petition was signed by the elector in the presence of the witness. The petition <br />may be in the form of separate sheets, each sheet containing at the top thereof the petition <br />as set forth above, and when bound together and offered for filing, shall be deemed to <br />constitute one petition. <br /> <br /> <br />
