December 9. 1969 <br /> <br />5.03. Temporary Transfer of Personnel Between Departments. <br /> <br /> The city manager shall have power, whenever the interests of the city require, <br />irrespective of any other provisions of this charter, to assign employees of any department, <br />bureau, office or agency, the head of which is appointed by the city manager, 5o the temporary <br />performance of duties in another department, bureau, office or agency. <br /> <br />ARTICLE VI <br /> <br />Other City Officers <br /> <br />6.01. Election and Term of Elected Officers. <br /> <br /> There shall be one attorney for the Commonwealth, one commissioner of the revenue, <br />one city ~reasurer and one city sergeant, elected by the qualifed voters of the City of <br />Ports-mouth, on Tuesday after the firs~ Monday in November, nineteen hundred and seventy- <br />three, for the term of four years, and every four years thereafter. Those elected officers <br />shall enter upon the discharge of their duties on the first day of January immediately <br />following their election. <br /> <br />6.02. Attorney for the Commonwealth. <br /> <br /> The attorney for ~he Commonwealth for the City of Portsmouth shall have such <br />duties as shall be imposed upon him by general law and by this charter. He shall prosecute <br />the violations of all city ordinances in the courts not of record of the City of Portsmouth, <br />when requested by the judges of such courts, and upon appeal in the court of hustings, <br />and shall notify the city attorney of all such prosecutions in which the validity of a <br />city ordinance is attacked. <br /> <br />6.03. City Treasurer. <br /> <br /> In addition to the duties imposed upon him by State law, the city treasurer shall <br />have such other official duties as may be imposed upon him by this charter and the ordinances <br />of the City. He shall collect and receive all city taxes, levies, assessments, license <br />taxes, rents, fees and all other revenues or moneys accrued to the city, and for that purpose <br />shall be vested with any and all powers which are now or may hereafter be vested in such <br />city treasurer as collector of the state taxes. He shall be the custodian of all public <br />moneys of the city, and of all other moneys coming into his hands as city treasurer. <br /> <br />§ 6.04. Commissioner of the Revenue. <br /> <br /> The commissioner of the revenue shall perform such duties not inconsistent with <br />the laws of the state in relation to the assessment of property and licenses as may be <br />required by the council for the purpose of levying city taxes and licenses. He shall <br />have power to administer such oaths as may be required by the council in the assessment <br />of license taxes or other taxes for the city. He shall make such reports in regard to <br />the assessment of both property and licenses, or either, as may be required by tha~ council <br />or by the city manager. He shall perform such other duties and have such other powers <br />as are now or may hereafter be prescribed by law or ordinance. <br /> <br />6.05. Clerks of Court. <br /> <br /> Notwithstanding any provision of general law, the clerks of the courts of record <br />of the city shall each be paid a salary as provided by law, which salary shall be in full <br />compensation for services and shall be in lieu of the retention by such clerk of any and <br />all official fees and commissions of whatever kind or character, and from whatever source <br />derived, and the council shall provide for the payment of such salary out of the treasury <br />of the city. The expenses of office of such clerk, including compensation of deputies <br />and employees, shall be likewise paid out of the treasury of the city on duly authenticated <br />vouchers, when and as such expenses are incurred, or may become due and payable. <br /> <br /> All fees and commissions of every kind or character received or collected by <br />such clerk, and from whatever source derived, shall be paid into the treasury of the city <br />not less than once each month. All fees and commissions of every kind and character, <br />whether payable by the state, the United States, or by private persons, firms or corporations <br />now or hereafter receivable by law or ordinance by such clerk, shall continue ~o be paid <br />to and collected by him, and shall be paid into the treasury of the city, except that <br />the city shall no~ be required to pay any such clerk any fees or commissions for services <br />performed for such city. <br /> <br />6.06. City Sergeant. <br /> <br /> In addition ~o the duties imposed upon him by state law, the city sergeant and <br />his deputies are authorized and directed to accept and receive payment-of such fines and <br />cos~s~zmay have been imposed upon any person in his custody by~a court of competent jurisdi~'~ <br />tion, giving his official receipt therefor. Upon the payment of such fines and costs, <br />the city sergeant or his deputy shall release the offender from custody if not prohibited <br />by law or court order. Any moneys so received shall be accounted for and paid over to <br />the clerk of the court which imposed such penalty upon the offender immediately upon the <br />opening of such clerk's office on the next regular business day or as soon thereafter <br />as practicable. The clerk shall give his official receipo to the city sergeant for such <br />monies so received. <br /> <br /> <br />
