U~h~llm~ 24. 197~ <br /> <br />At a regular meeting of the City Council held on February 24, 1970, there were present: <br /> <br />Jack P. Barnes, James W. Holley, Burrell R. Johnson, Isaac W. King, R. Irvine Smith, Raymond Turner, <br />A. P. Johnson, Jr., City Manager, and ~. A. Korb, Jr., City Attorney. <br /> <br />The meeting was opened with prayer by Mr. King. <br /> <br />70-77 - The following~hearing on rezoning: <br /> <br />Petition Z 70-6 - J. Lester Gregory by Agent E. Stuart Ball <br /> <br />The following letter from Mr. Ball was read: <br /> <br /> "It is respectfully requested that the public hearing on the rezoning application of J. Lester Gregory <br />be deferred until your next meeting. This rezoning is opposed by the Portsmouth School Board because they de- <br />sire this property for playground use. They have employed an appraiser to determine the value of said property, <br />and as yet, he has been unable to do so. In all fair~ess to the school board, I feel that this matter should <br />be deferred until they have had an opportunity to get the data they need." <br /> <br /> Motion of Mr..Holley to grant the request and postpone action on the following ordinance tnntil the next <br />regular Council meeting, was adopted, without dissenting vote: <br /> <br /> "ZONING AMENDM~ENT ORDINANCE Z 70-6" <br /> <br />T~e' ~oilowing reports from the City Manager were read: <br /> <br /> 70-78 - "I submit the attached ordinance and recommen~ it be placed on first reading. This appropriates <br />$25,000 for the appraisal of business personal property and machinery and tools. This work is being done by <br />the United Appraisal Company for the office of the Commissioner of Revenue which is charged with the assessment <br />of these taxes. ' <br /> <br /> These appraisals will cover approximately 2,~00 personal property accounts and 95 business and manufacturin <br />concerns. This appropriation covers the funds needed for this fiscal year. The b~lance of the project will be <br />funded in the 1970-71 budget." <br /> <br />On motion of Mr. Smith, the following ordinance was approved on first reading, without.dissenting vote: <br /> <br />"AN ORDINANCE TO APPROPR~AT~i$25,000.00 FROM THE GENERAL FUND FOR THE APPRAISAL OF <br />PERSONAL PROPERTY, MACHINERY ~ND TOOLS FOR TAX PURPOSES." <br /> <br /> 70-79 - "I submit the attached ordinance and recommend it be placed on first reading. <br />$56,000 for the purchase of gas lights in the Olde Towne Conservation Project. These 225 <br />received from England and will be located throughout the Olde Towne Conservation Project. <br />represents a portion of the local cost on a 2/3 - 1/$ basis in this conservation project. <br /> <br /> This appropriates <br />gas lamps are being <br />This appropriation <br /> <br />We are required to Day $18,000 at this time and the balance when final acceptance for the lamps is made." <br /> <br /> Motion of Mr. Johnson to refer the following ordinance to a conference for further 'consideration was <br />adOPted With one dissenting vote - that of B~. Holley: <br /> <br />";aN ORDINJ~NCE TO BI°PROPRIATE $56,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR <br />THE PURCHASE OF GAS LIGHTS FOR THE OLDE TOWNE CfANSERVATION PROJECT." <br /> <br /> 70-80 - "I submit the attached ordinance and recommend it be placed on first reading. This requires any <br />person who has been convicted of a felony within ten years prior to the effective date of this ordinance, or <br />who may hereafter be convicted of any offense punishable as a felony who comes into the City from any point <br />outside of the City and remains in the City for a period exceeding twenty-four [24) hours, to report to the <br />Chief of Police within twelve (12) hours after his arrival ~thin the boundaries of the City. <br /> <br /> It further requires that he furnish his t~ue name and all aliases; a full and complete description of his <br />person; the kind, character and nature of each crime of which he has been convicted; the place where any s~ch <br />crimes were committed; the name under which he was convicted; the name, if any, and the location bf each prison, <br />reformatory, jail and other penal institution in which ~e was confined; and the location and address of his <br />residence, stopping place, or living quarters in the City. <br /> <br /> This exempts anyone who has received a full and unconditional pardon, or to any person who is on probation <br />under the laws--.of the State, or whose probation period shall have expired without any revocation of such pro- <br />bation~ <br /> <br />This ordinance.is similar to one that thas been adopted by other political subdivisions in the area." <br /> <br />On motion of Mr. Johnson, the following ordinance was approved on first reading, without dissenting vote: <br /> <br />"AN ORDINANCE TO ~%~ND THE CODE OF ~HE CITY OF PORTSMOL~N, VIRGINIA, 1961, BY ADDING <br />TO CHAPTER 7 ~HERHOF, A NEW ARTICLE, NUMBERED VI, CONSISTING OF SECTIONS 7-42 TO 7-49, <br />INCLUSIVE, REQUIRING FELONS TO REGISTER WITH THE CHIEF OF POLICE, PERTAINING TO THE <br />FO~M, CUSTODY B>~D USE OF SUCH -.REGISTRATION REPORTS, AND PROVIDING PENALTIES FOR THE <br />VIOLATION THEREOF." <br /> <br /> 70-81 "I submit the attached resolution and recommend its adoption. This conf~rms and ratifies the <br />issuance ~of $6009~00 in notes issued for the purchase of the Merrifields Water System. They cover a period of <br />~elve [12~ years with payment being made at the rate of $50,000 annually for the purchase of this system. They <br />bear an~interest rate of 5-1/4 percent, and covers the pur~nase of the water ystem as well as the sewer system, <br />This is in accordance ,with the agreement authorized by the City Cquncil a~ the meeting on January 27, 1970." <br /> <br /> <br />
