March 24, ]970 At a regular meeting of the City Council, held on March 24, ~70~ there were present: Jack P. Barnes, George D. Eastes~ James W. Holley~ ~urrell R. Johnson, Isaac W. King~ R. Irvine Smith, Raymond Turner, A. P. Johnson~ Jr.~ City Manager~ M. A. Xorb~ Jr. City Attorney and R. D. Ottavio, City Auditor. ~ just The meeting was opened with prayer by M~ King. Minutes of the previous meeting were read and approved. 70-~20 - Mr. Smith made the following statement; ~Before we go into the regular order of the agenda~ I would like to have the floor a brief moment. for It has been alleged recently that the City Manager and the City Auditor have been guilt~ of exercising poor judgment. Since every human being qualified to or charged with the duty to make decisions or judgments, is guilty of this same weakness~ I move that we give these men a vote of confi- dence and I hope that in the future they may attain that quality of perfection so rare amongs all of us.~ The motion was unanimously adopted. 70-~21 - The following hearing on zoning changes was held: Zoning Petition Z 70-7 - Harold C. Bea~er of R-B Realty Company No one spoke. On motion of Mr. Holley, the following ordinance was approved on first reading, without dissenting vote: ZO,~ING A~,[END~ENT ORDINANCE Z 70-7~ Use Permit 70-5 - Petition of Virginia Holding Corporation by Virginia Electric & Power Company Mr. Kilgore ~poke. On motion of Mr. Turner, the following resolution was adopted, without dissenting vote: ~A RESOLUTION GRANTING A USE ~EP~,~IT FOR THE CONSTRUCTION AND OPERATION OF AN ELECTRIC ' ~R~NS~OR~R~!~STAT~ON~ ~T~!~HEZNORTHEAST INTERSECTION OF CEDAR LANE AND THE NORFOLK, FRA~KaI~ ~ND DANVILLE RAILWAY. WHEREAS, the Virginia Electric and Power Company has made an application pursuant to Section 4-2 of the Zoning Ordinance of the City Of Portsmouth, 1961, for the grant- ing of a use permit as hereinafter described~ and WHEREAS, the applicant and the Planning Director have done all things required to be done in connection with said application~ and the Planning Gommission has recommended the granting of said use permit, subject to the conditions hereinafter stated. NOW~ THEREFOR~ BE IT R~SOLVED by the Council of the City of Portsmouth, Virginia: A. That the use for which the use permit hereinafter described is sought (1) will not adversely affect the health or safety of persons residing or working in the neigh- borhood of the proposed use~ (2) will not be detrimental to the public welfare or injurious to property or improvements in the neighborhood~ and (3) will be in accord with the pur- poses of said Zoning Ordinance. B. That the Virginia Electric and Power Company is hereby granted a use permit, subject to site plan restrictions, pursuant to Section 4-2 of said Zoning Ordinance, for the operation of an electric transformer station located on the property described as follows: ~eginning approximately 30 feet northeast of the northeast corner of Cedar Lane and the Norfolk, Franklin and Danville Raitway~ thence north- east along Cedar Lane 159.~l~f~e~dt~ ~he~;~S~:Ga~ernment Railroad right- of-way; thence northwest along said railroad right-of-way 3~4,72 feet to the south right-of-way line of the proposed Western Freeway (Interstate 1~4)~ thence northeast along said right-of-way 483.4 feet~ thence southeast 284.4 feet to the City of Norfolk water line right-of-way; thence southwest along said right-of-way 602.29 feet to the point of origin." Proposed Zoning Ordinance Amendments: ~AN ORDiN~MCE TO ~W~ND THE ZONING ORDINANCE OF THE CITY OF PORTSMOUTH, 1961, BY AMENDING SECTION 4-9.1 THEREOF SO AS TO PERMIT ONLY SINGLE FAMILY AND TWO FAMILY D$~ELLINGS TO BE CONSTRUCTED FOR RESIDENTIAL USE IN THE OFFICE RESIDEN- TIAL 0R-75 ZONING DISTRICT.I~
