~{arnh 30, 1970 , <br /> <br />At a special meeting of the City Council, held on March $0, 1970, there were present: <br /> <br />Jack P. Barnes, George D. Eastes, James W. Motley, Burrell R. Johnson* Isaac W. King, R. Irvine Smith, <br />Raymond Turner, A. P. Johnson, Jr., City }~anager, and M. A. Kerb, Jr., City Attorney. <br /> <br />The meeting was opened with prayer by ~.lr. King. <br /> <br />The following call for the meeting was read: <br /> <br /> "Please attend a called meeting of the City Council, in the Council Chamber, at 7 P.M., on Monday, <br />March 50, 1970, to consider the following resolution: <br /> <br />WA RESOLUTION AUTHORIZING THE FILING OF AN APPLICATION FOR A GR~T TO ACQUIRE AND <br />DEVELOP LAND UNDER THE PARKS-IN-CITIES PROGRA~ OF THE OPEN-SPACE LkND PROGRAM? <br /> <br />70-140- The following letter from the City Manager was ~ead: <br /> <br /> "I submit the attached resolution mud recommend its adoption. This authorizes the submission of an <br />application for a grant from the Department of Housing and U~San Development to establish recreational parks <br />in the City. <br /> <br /> This will establish six playgrounds under the Parks-in-Cities Program. Under this, the Federal Govern- <br />ment will pay 50% of the cost of acquisition and development which includes equipment. These parks are to be <br />located as follows: <br /> <br />2 - Southside <br />i - Old Green Street School Site <br />1,- Prentis Park <br />1 - Carver Homes <br />1 - 2000 Block of County Street <br /> <br /> It i~ necessary that this resolution be adopted at this time as our application under this program nmst <br />be received ~y HUD no later than April 5, 1970. The estimated total cost under this program is $168,064, of <br />which 50% will be the City's cost." <br /> <br />On motion of Mr. Turner, the following resolution was adopted, without dissenting vote: <br /> <br />"A RESOLUTION AUTHORI~.ING THE FILING OF AN APPLICATION FOR A GR~NT TO ACQUIP~ AND <br />DEVELOP LAND b.~DER THE PARKS-IN-CITIES PROGRAm{ OF /}IE OPEN-SPACE LAND PROGRAm4 <br /> <br /> WHEREAS, Title VII of the Housing Act of 1961~ as amended, provides for the m~king of ~rants by the <br />Secretary of Housing and Urban Developmentib States and local public bodies to assist them in the acquisition <br />and development of permanent interests in land for open-space uses where such assistance is needed for carrying <br />out a unified or officially coordinated program for the provision and development of open-space land as part <br />of the comprehensively planned development of the urban area; and <br /> <br /> ~HEP~AS, the City of Portsmouth Cnerein sometimes referred to as "Applicant") desires to acquire the fee <br />simPle interest to certa2%J1 lands and to develop them under the Special Parks-in-Cities Program, said lands <br />being located, generally, as follows: Southside (two sites), Green Stmeet, Prentis Park, Cottage Place, and <br />Csrver Apartments; and <br /> <br /> WH£REAS, s~f~ parcels of land will be held and used for permanent open-space land for recreational and <br />park purposes; and <br /> <br /> WHEP£AS, Title VI of the Civil Rights Act of 1964, and the regulations of the Department of Housing and <br />Urb~ Develppment effectuating that Title, provide that no person shall be discriminated against because of <br />race, color, or national origin in the use of the land acquired; and <br /> <br /> WHEREAS, it is recognized that the contract for Federal grant will imPose certain obligations and respon- <br />sibilities upon the Applicant and will require among other things (1) assurances that families and individuals <br />displaced as a result of the open-space land project will be relocated into decent, safe, and sanitary housing, <br />(2) compliance with Federal labor standards, and [S) compliance with Federal requirements relating to equal <br />employment opportunity; and <br /> <br />}~EREAS, it is estimated that the cost of acquiring said interest will be $91, 714.00; and <br /> <br />'/,.~qEREAS, it is estimated that the cost of development of said land will be $74,750.00; and <br /> <br /> I~EREAS, it is estimated that the cost of necessary demolition and removal of improvements on said <br />land will be $1,600.00; and <br /> <br /> WHBREJS, it is estimated that the total amount of relocation payments to be made to eligible site <br />ooc~pants displaced from property to be acquired will be $12,000.00; and <br /> <br />N~, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF PORTSMOUTH, VIRGINIA: <br /> <br /> 1. That an application be made to the Department of Housing and Urban Development for a grant in an <br />amount authorized by Title VII of the Mousing Act of 1961, as amended, which amount is presently estimated <br />to be $96,052.00, and that the Applicant will pay the balance of the cost from other funds available to it. <br /> <br /> 2. ~nat adequate open-space land for the locality cannot effectively be provided through the use of <br />existing undeveloped or predominantly undeveloped land. <br /> <br /> 3. That the City Manager iS hereby authorized and directed to execute and to file such application with <br />the Department of Housing and Urban Development, to provide additional information and to furnish such documents <br />as may be required by said Department. to execute such contracts as are required by said Department, and to act <br /> <br /> <br />
