~ 8(~ November.24, 1998 At a Called Meeting of the City Council on Tuesday, November 24, 1998, there were present: Mayor James W. Holley III, Vice Mayor Bernard D. Griffin, Sr., Cameron C. Pitts, P. Ward Robinett, Jr., J. Thomas Benn III, William E. Moody, Jr., Charles B. Whitehurst, Sr., City Manager Ronald W. Massie, City Attorney G. Timothy Oksman. 98-259 The following call for the meeting was read: "Please attend a Called Meeting of the City Council to be held in the City Manager's Conference Room, 801 Crawford Street, 6th floor, 5:00 p.m., Tuesday, November 24, 1998, for the purpose of a Public Work Session. In addition, you may consider a motion to go into an Executive Session. By order of the Mayor." 98-260 The following item was discussed in Public Work Session: 1. Discussion of Legislative Proposals with Portsmouth Delegation In attendance were from the General Assembly were: Senator L. Louise Lucas, Senator Frederick M. Quayle, Delegate Kenneth R. Melvin, and Delegate Johnny S. Joannou Motion by Mr. Pitts, and seconded by Mr. Berm, to go into Executive Session pursuant to provisions of Section 2.1-344 of the Code of Virginia, to discuss or consider the following: The condition, acquisition or use of real property for a public purpose, or the disposition of publicly held property, as permitted by Subsection (A)(3). The subject real estate is the Pinners Point Connector. Consultation with legal counsel pertaining to pending litigation, as permitted by Subsection (A)(7). The litigation is pending against the City in Portsmouth Circuit Court. Amended motion by Mr. Pitts, and seconded by Mr. Whitehurst, to include appointments by Council to committees, boards, or commissions, as permitted by Subsection (A)(1). Motion was adopted by unanimous vote. Motion by Mr. Pitts, and seconded by Mr. Griffin, pursuant to Section 2.1-344.1 of the Code of Virginia certifying that to the best of the Council Member's knowledge during the immed ately preceding Executive Session of the City Council: 1. Only public business matters lawfully exempted from open meeting requirements by the Virginia Freedom of Information Act, and Only such public business matters as were identified in the motion by which the Executive Session was convened, were heard, discussed or considered in the meeting by the City Council.
