<br /> One year from date, the City of Portsmouth promises to pay to the order of R. L. Magette,
<br />negotiable and payable without offset, at the main banking office of American National Bank,
<br />in said City of Portsmouth, Twenty~wo Thousand Dollars ($22,000.00) for value received,
<br />with interest at the rate of five and one-~uarter (5~1/4) per centum per annum, payable
<br />semi-annually, from the date hereof until payment of the principal sum.
<br />
<br /> This note may not be prepaid within three years of date, unless its maturity falls
<br />sooner, or unless the holder so agrees.
<br />
<br /> This note shall be a general obligation of the City of Portsmouth, Virginia, payable
<br />from taxes which may be levied, without limitation of rate or amount.

<br />. 2. Ail actions of the City Manager done in connection with the issuance of said $110,000
<br />of General Obligation Notes is hereby confirmed and ratified. The execution of said notes
<br />on behalf of the City of Portsmouth by the City Treasurer is hereby confirmed and ratified.
<br />The action of the City Clerk in affixing the seal of the City to said notes and attesting
<br />thereto is hereby confirmed and ratified.
<br />
<br />3. The full faith and credit of the City of Portsmouth is hereby pledged to the principal
<br />of and interest on the notes as the same become due. For the payment of such principal
<br />and inter~st, the City of Portsmouth shall have power and be obligated to levy and ad valorem
<br />taxes without limitation as to rate or amount on all the property subject to taxation by
<br />the City." ~

<br /> 71-6 - ",I submit the attacked resolution and recommend its adoption. This appoints
<br />five viewers for the closing of Cutoff Avenue as it lies north of Greenwood Boulevard and
<br />south of the northern right-of-way of Jackson Avenue~ Jackson Avenue as it lies west of
<br />the eastern right-of-way of Laigh Road and east of the western right-of-way of Cutoff Avenue
<br />Laigh Road as it lies north of the northern right-of-way line of Jackson Avenue and south
<br />of the southern right-of-way line of U. S. 264.

<br /> These closings have been requested by the Washington Heights Property Corporation and
<br />have been approved by the Planning Commission."

<br /> On motimn of Mr. Smith (R), the following resolution was adopted and by the following
<br />vote:

<br />"R RESOLUTION APPOINTING VIEWERS FOR CLOSING OF PORTIONS OF CUTOFF AVENUE,
<br />JACKSON AVENUE AND LAIGH ROAD.
<br />
<br /> WHEREAS, Washington Heights Properties Corporation has made application to vacate and
<br />close the hereinafter described portions of certain streets and it appearing that notice
<br />of the application and request for the appointment of viewers was duly posted on December
<br />16, 1970 on the bulletin board of the Court of Hustings for the City of~ Portsmouth, on
<br />the bulletin board of the Circuit Court of the City of portsmouth, and on the bulletin
<br />board of the Municipal Court, Civil Division of th~ City of Portsmouth.
<br />
<br /> NOW, THEREFORE, Be it resolved by the Council of the City of Portsmouth, Virginia, that
<br />Frank N. Bilisoly, Luther Tapp, James Choate, Joseph Kiss and Zalmon I. Blachman be appointed
<br />viewers to view the hereinafter described portions of streets and report to this Council
<br />in writing whether in their opinion any, and if any, what inconvenience would result from
<br />vacating and closing the following:

<br />1. Cutoff Avenue as it lies North of Greenwood
<br />Boulevard and South of the northern right of way line of JacMson Avenue.
<br />
<br />2. Jackson Avenue as it lies West of the eastern right-of-way line of Laigh Road
<br />a~d East of the western right-of-way line of Cutoff Avenue.
<br />
<br />3. Laigh Road as it lies North of the northern right-of-way line of Jackson Avenue
<br />and South Of the southern right of way line of U. S. Interstate 26~.'
