At a regular meeting of City Council, held on January 11, 1972, in the City Council <br />Chambers, there were present: <br /> <br />Jack P. Barnes, James W. Holley, Burrell R~ Johnson, Isaac W. Ottavio, City Auditor. <br /> <br />R;~?I~uine <br /> Jr., City Attorney, <br /> <br />Prayer was offered by Councilman Isaac W. Kingt <br /> <br />Mayor Barnes extended a word of welcome to visitors.in attendance. <br /> <br /> 72-1(a) Mayor Barnes presented the"Key to the City" to Miss Susan Heely, Portsmouth's <br />"Junior Miss [or 1972- <br /> <br /> 72-1(b) Mayor Barnes presented Mr. Harvey N. Johnson, Jr. <br />for ~er~fice'~h~ ~ianning Commission. <br /> <br /> On motion of Mr.;R~ymond Smith and seconded by Mr. King, the minutes were approved as <br />corrected by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Bar~$ <br />Nays: None <br /> <br />72-2 Public Hearing on Charter amendment was presented: <br /> <br /> "Pursuant to the requirements of Section 15.1-912 of the Code of Virginia, notice is <br />hereby given that the Council of the City of Portsmouth will hold a public hearing at 7:30 <br />P.M., January 11, 1972, in the council chambers, fourth floor, Municipal Building, No. 1 <br />High Street for the purpose of considering amendments to the City Charter, Sections 10.01, <br />10.02 and t0.09 thereof, which would lower the numbe~ of signatures required to petition the <br />institution of initiative, referendum, or recall. The subject amendments would require that <br />such petition be signed by at least thirty per cent of the electors actually ¥oting ~n the <br />last preceding gubernatorial election rather than tRirty per cent of the electors eligible <br />to vote in the last preceding general election as is presently required by the City C--~r.'d <br /> <br /> Mr. George R. Walker spoke against the hearing of Proposed Charter change, since there <br />was inadequate advertisement so he claimed. <br /> <br /> On motion of Mr. King and seconded by Mr. Irvin~ Smith, the following resolution was <br />adopted, and by the following vote: <br /> <br />"RESOLUTION REQUESTING THE GENERAL ASSEMBLY OF VIRGINIA TO AMEND THE CHARTER <br />OF THE CITY OF PORTSMOUTH, VIRGINIA. <br /> <br /> WHEREAS, Sections 15.1-835 and 15.1-912 of the Code of Virginia, 1950, as ammended, <br />provide for the amendment of the City Charter upon the holding of a public hearing and <br />the request of the City Council to the General Assembly; and <br /> <br /> WHEREAS, the City Council is of the opinion that certain amendments to the Charter <br />of the City of Portsmouth are necessary and desirable at this time and has held the public <br />hearing required by law to consider such amendments. <br /> <br /> NOW THEREFORE BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, that <br />the City Attorney is hereby directed to prepare and transmit to the General Assembly, to- <br />gether with certified copies of this resolution, drafts of bills amending the Charter of <br />the City of Portsmouth by amending Sections 10.O1, 10.02 and 10.O9 thereof to read as follows <br /> <br />Section 10.01. Petition for Initative. <br /> <br /> (a) Any proposed ordinance, including any ordinance for the repeal or amendment of <br />an existing ordinance may be submitted to the council by petition signed by electors equal <br />in number to at least thirty per centum Of the electors eli~i~l~ ~e~v~e vpt~ng for governor <br />in the last preceding g~herat~gubernatorial election. Such petition shall contain the <br />proposed ordinance in full. <br /> <br />(b) The petition shall be substantially in the following form: <br /> <br />To the Council of the City of Portsmouth, Virginia: <br /> <br /> We, the undersigned, qualified electors of this city, respectfully petition your honore <br />able body to ordain the following ordinance: <br /> <br />Signature of Elector Street Address Date Signed <br /> <br /> (c) The execution of the petition by an elector shall be acknowledged by him, or <br />it may be proved by the oath of a witness who shall swear that he knows the elector and <br />that the petition was signed by the elector in the presence of the witness. The petition <br />may be in the form of separate sheets, each sheet containing at the top thereof the petition <br />as set forth above, and when bound together and offered for filing, shall be deemed to <br />constitute one petition. <br /> <br /> <br />
