THEREOF, A NEW ARTICLE CONSISTING OF ONE SECTION, PER- <br />TAINING TO GOING OUT OF BUSINESS SALES." ~ <br />On motion of Mr. Turner, seconded by Mr. Raymond Smith, the ordinance was adopted, by the <br />vote: Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br /> Nays: None <br /> <br />72-236 The following ordinance approved at last meeting, was taken up and read: <br /> <br />"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, <br />BY REPEALING SECTIONS 19-68, 19-68.1, 19-68.2, 19-68.3 AND 19~69 THEREOF <br />PERTAINING TO SUNDAY OBSERVANCE, WORKING OR TRANSACTING BUSINESS AND CERTAIN <br />PENALTIES, AND BY AMENDING SECTION 19-4 THEREOF PERTAINING TO ENCOURAGING <br />PROCURING OF ABORTION BY ADVERTISEMENT." <br /> <br /> On motion of Mr. Raymond Smith and seconded by Mr. Holley, the ordinance was adopted, <br />and by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />NEW BUSINESS <br /> <br /> 72-272 - The following letter received from Dr. M. A. Kise, member of School Beard, <br />was read: <br /> <br /> "Due to matters of personal health and pressing business commitments, it is increasingl) <br />difficult for me to devote the time and effort to School Board matters that they deserve. <br />Since the term of my latest appointment expires June 30, 1972, please feel free to make <br />whatever choice you and other Council members consider helpful to Dr. Alford without any <br />further consideration being given to me. <br /> <br /> Serving-as a member of the School Board has been an enlightening experience and hope- <br />fully my service has been of help to-the Superintendent a~d his staff during these times of <br />traumatic changes, both social and educational. <br /> <br /> I appreciate the confiedence that you and other members of Council have shown in me, <br />from time to time, in appointing me to the Board." <br /> <br /> On motion of Mr. Irvine Smith and seconded by Mr. King, to be received with regrets, <br />refer to a conference and suitable ce.rtificate of appreciation to be presented to Dr. Kise, <br />was adopted by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br />72-273 - The following-letter received from City Attorney W. J. O'Brien, Jr. was read: <br /> <br /> "On June 23, 1971, the Council of the City of Portsmouth established the Zoning~Ordi- <br />nance Study Commission which was to review the Zoning~Ordinance and make recommendations <br />thereon prior to July 1, 1972. As Chairman of said Commission, I respectfully request <br />placement on the agenda of the regularly scheduled Council meeting of June 27, 1972 for the <br />purpose of speaking in regard to the Commission, its deliberati6ns, a~d~its report. At that <br />time, I will present to the City Council the report of the said Commission." <br /> <br />Mr. O'Brien spoke. <br /> <br /> Motion of Mr. Holley and seconded by Mr. Johnson, to accept the report with accommo- <br />dation and hold in abeyance the dissolving of this commission until the Council has had time <br />to study the matter. Refer the ordinance to the Planning Commission for proper handling for <br />public hearing, was adopted by the following vote: <br /> <br />Ayes: Holley, Johnson, King, Irvine Smith, Raymond Smith, Turner, Barnes <br />Nays: None <br /> <br /> 72-274 The following letter received from Mr. Eddie E. Ellis, 3306 Nelson Street, <br />was read: <br /> <br /> "I am writing <br />Road 3300 block, <br />center of the road <br /> <br />this letter on a matter concerning the Telephone Company and Turnpike <br />which is a single lane highway. The Telephone Company has a hole in the <br />they work through on the maintenance of the phone wmres. <br /> <br /> The hours of maintenance is enormous through the week, for the amount of trafficz~hat <br />goes by this one spot. The curb of the road~ one right-hand side going out of town is full <br />of "chuck" holes, because of the traffic. So, I suggest this road be widened at least one <br />lane from Frederick Boulevard to the DMV and a tunnel be furnished on the south side of the <br />road going out side of town, for the Telephone Company to have access work and their existin <br />hole in the road be elminated. I hope this will be look into. I've already talked 'to <br />Mr. Frank Hawkins of Public Works, about this." <br /> <br /> <br />
