<br /> "On Monday night, August 7, 1972, I appeared, through my attorney, at the public hearin
<br />on the above captioned matter. The Council passed this item over objections~of certain
<br />citizens of the area. Certain comments were made, however, that have caused me much concern
<br />and I wish to state my views directly to you about this.
<br />
<br /> First, I am the ovner and operator of two roller skating rinks in this state. The
<br />operation of these rinks is geared toward youth patronage. A large percentage of the patron~
<br />are adult-supervised youth groups from church organizations. My operational record in
<br />Virginia Beach has brought commendation from the Virginia Beach police. I have supervised
<br />the operation carefully by the use of o~f~d~ty poli~em~ea~d t~ m~ knowledge, or that of
<br />the police, no illegal drug activity has occurred within, or adjoining the skating rink
<br />facilities. Likewise, I have standing rule that no one drinking, or suspected of having
<br />alcoholic drinks, is permitted on~th~ premises. This is essential for my business because
<br />to do otherwise would discourage patronage by parents and their children. Likewise, ~ h~ve
<br />been overly zealous in policing my parking areas to prevent loitering ar~l~va~dalism. This ha~
<br />been a major factor in my business success.
<br />
<br /> Semondly, I believe that the structure that I will construct on, this shopping center
<br />complex will be compatible with the design of other structures in the neighborhood. The
<br />building is desinged to contain interior noise within the bu~d~Bg. Little truck service
<br />is required for this operation and all such service will enter through the front of the
<br />structure off, the parking lot. The rear of the property is presently buffered from adjoin-
<br />ing property by vegetation growth. Clearing of undesirable growth is anticipated but tree
<br />g~wth will be maintained and supplemented to provide permanent screening of the rear lot.

<br /> Thirdly, vehicular traffic will flow uninterruped over the shopping center complex
<br />Portsmouth Boulevard and Hodges Ferry Road, with no increased traffic interference over
<br />residential area streets.

<br /> Fourthly, the skating rink operation will not conflict with normal Sunday church
<br />schedules. The center will be closed on Sunda~ morning, and between 6:00 P.M. and 8:00 P.M.
<br />Sunday evening. It is my plan to continue to encourage church sponsored youth groups to
<br />use the facilities after the normal church activities have ended. I should like to point
<br />out that my present facility in Virginia Beach is used on Sunday mornings by a church for
<br />its services. These activities have proven most compatible with my business operations.

<br /> In conclusion, I believe that my prgposed skating rink will
<br />hood, and [ fully believe that it will be an asset to this City.

<br />It would also mean that the citizens of Portsmouth would not have to go to Norfolk or
<br />Virginia Beach to enjoy this type of recreation. The young people in my church go t~tAe
<br />skating rink often. It would be a splendid thing if they did not have to travel so far.

<br />from C-1 to C-2 for the purpose of erecting a roller skating rink. He has indicated that,
<br />in addition to the natural buffer provided by the~ees to the rear of the property, he will
<br />screen the rear of his property by fencing. This letter is to g~arantee, on the part of the
