<br /> Prayer was offered by Councilman King.
<br />
<br /> 72-414 Public Hearing and rezoning and use permit on the following was held:
<br /> Zoning Petition Z 72-41 Petition of Peachtree Associates
<br />
<br /> Benjamin J. Levy, Attorney, spo~e for C-1.
<br />
<br /> On motion of Mr. Smith and seconded by Mr. Early, to concur with
<br />the Planning Commission, the following ordinance was approved on
<br />following vote:
<br />
<br /> "ZONING AMENDMENT ORDINANCE Z 72-41"
<br />
<br /> Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes
<br /> Nays: None
<br />
<br /> Zoning Petition Z 72-42 Petition of Foley Ship Cleaners, Inc.
<br />
<br /> Donald Kilgore, Attorney, spoke in favor of M-1.

<br />Motion of Mr. Smith and seconded by Mr. King, to concur with the recommendation of
<br />Planning Commission, petition denied, was adopted by the following vote:

<br /> Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes
<br /> Nays: None
<br />
<br /> Zoning Petition Z 72-44 Petition of Jack B. Jacobson, et ux, et als.

<br /> Motion of Mr. Johnson and seconded by Mr.
<br />on first reading, and by the following vote:

<br />"ZONING AMENDMENT ORDINANCE Z 72-44"

<br />Smith, the following ordinance was approved
<br />
<br /> "I have just been retained by the applicant regarding the above matter. After going
<br />over the application with Mr. Bright, I find that a site plan has not been prepared, and
<br />that in order for the Council to act upon this matter, a site plan is necessary.
<br />
<br /> I respectfully request that this matter be referred back to the Planning Commission for
<br />further consideration.
<br />
<br /> In the absence of Council granting me the above request, please consider this letter as
<br />a withdrawal of the above application for consideration by Council at this time."

<br /> Motion of Mr. Smith and seconded byMr. Johnson, the matter be referred back to Planning
<br />Commission and applicant is to submit site plan, was adopted by the following vote:

<br />72-415 The following ordinance was read:

<br />"AN ORDINANCE TO AMEND THE ZONING ORDINANCE OF THE CITY OF PORTSMOUTH, VIRGINIA,
<br />t961, BY ADDING THERETO A NEW SECTION NUMBERED 5A-17, PERTAINING TO FEES CHARGED
<br />FOR PROCESSING A PLANNED UNIT DEVELOPMENT APPLICATION."
<br />
<br /> On motion of Mr. Smith and seconded by Mr. Early, the ordinance was approved on first
<br />reading, and by the following vote:
