"AN ORDINANCE TO AMEND THE CODE OF THE CITY OF PORTSMOUTti, VIRGINIA, 1961, <br /> BY REPEALING SECTION 31-3 THEREOF AND BY AMENDING SECTIONS 31-2, 31-9, 31-13, <br /> 31-15, AND 31-~4 THEREOF PERTAINING TO CITY STREETS AND SIDEWALKS AND BUILDING <br /> SETBACK LINES.'~ <br /> <br /> Ay~: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br /> Nays: None <br /> <br /> ?2-426 - "I submit the attached ordinance and recommend it be placed on first reading. <br />This amends Section 18-53 of the City Code pertaining to the use of chemical tests to <br />determine alcohol in the blood. <br /> These changes are necessary to conform to amendments made to the State Code at the <br />last session of the General Assembly. This is also part of the City Attorney's program <br />of updating the Code; <br /> The new ordinance allows either a chemical test to determine alcohol in blood or <br />the breath test, but not both, when arrested fOr suspicion of drunken driving." <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the following ordinance was approve¢ <br />on first reading, and by the following vote: <br /> <br /> "AN ORDINANCE TO ~END THE CODE OF THE CITY OF PORTSMOUTH, VIRGINIA, 1961, BY <br /> ~dENDING SECTION 18-53 THEREOF PERTAINING TO USE OF CHEMICAL TEST TO DETE~4INE <br /> ALCOHOL IN BLOOD; PROCEDURE; QUALIFICATIONS AND LIABILITY OF PERSON WITHDRAWING <br /> BLOOD; COSTS; EVIDENCE; SUSPENSION OF LICENSE FOR REEUSAL TO SUBMIT TO TEST." <br /> <br /> Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br /> Nays: None <br /> <br /> 72-42? - '~I submit the attached resolution and recommend its adoption. This appoints <br />viewers for the closing of a 16-ft. alley between ~rden Street and West Norfolk Road. <br /> <br /> The adjacent property owners have requested this closing and it has been approved <br /> by the Planning Commission. This_is a paper alley and never been opened." <br /> <br /> On motion of Mr. Johnson and secondedby Mr. Smith, the following resolution was adopted <br /> and by the following vote: <br /> <br /> "A RESOLUTION APPOINTING VIEWERS FOR CLOSING A PORTION OF A SIXTEEN FOOT ALLEY <br /> LOCATED BETWEEN ARDEN STREET AND WEST NORFOLK ROAD. <br /> <br /> ~EREAS, Pearl Spivey and Hortense Hathaway have made application to vacate and close <br />the hereinafter described portion of a certain alley and it appearing that notice of the <br />application and request for the appointment of viewers was duly posted on September 19, <br />1972, on the bulletin board of the Court of Hustings for the City of Portsmouth, on the <br />bulletin board of the Circuit Court of the City of Portsmouth, and on the bulletin board <br />of the Municipal Court, Civil Division of the City of Portsmouth. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that Frank N. Bilisoly, Louis J. Leitner, L. A. Clark, Zalmon I. Blac~man and F. J. Bergeron <br />be appointed viewers to view the hereinafter described portion of such alley and report <br />to this Council in writing whether in their opinion any, and if any, what inconvenience <br />would result from vacating and closing the following: <br /> <br />Beginning at the southeast corner of Arden Street and Tyre Neck Road; <br />thence south along the eastbmn~ight-of-way line of Tyre Neck Road <br />142 feet to a point which is the northern right-of-way line of a 16 <br />foot alley not improved which is the TRUE POINT OF BEGINNING; thence <br />east 188~.fee~ along the northern right-of-way line of said alley to <br />a point; thence south 16 feet to the southern right-of-way line of <br />said alley; thence west 185 feet along the southern right-of-way <br />line of said alley to the east right-of-way line of Tyre Neck Road; <br />thence north 16 feet along the eastern right-of-way line of Tyre <br />Neck Road returning to the TRUE POINT OF BEGINNING." <br /> <br />Ayes: Early, Hotley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 72-428 - "I submit the attached resolution and recommend its adoption. This requests <br />the State Highway Department to allow pedestrian access on the new West Norfolk Bridge <br />when constructed. The bridge is scheduled to be designated limited access along with <br />the Western Freeway.'~ <br /> <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION REQUESTING THE STATE HIGHWAY DEPARTMENT TO INCLUDE IN CONSTRUCTION <br />DESIGNS FOR THE NEW I~ST NORFOLK BRIDGE PEDESTRIAN WALKWAYS.~ <br /> <br /> WHEREAS, the 1985 Major Thoroughfare Plan presently allocates funds for the constructio~ <br />of a bridge at the West Norfolk Crossing; and <br /> <br /> WHEREAS, present construction design plans for such bridge do not contain provisions <br />for pedestrian watkways; and <br /> <br /> <br />
