<br /> 73-105 The following letter received from W. B. Wilkinson, Secretary, Department
<br />of Alcoholic BeYerage Control, was read:

<br /> "At a meeting yesterday the Board gave consideration to the resolution of your CouncJ
<br />dated March 27,1973, requesting that the hours of sale and consumption of alcoholic bever-
<br />ages in your city be extended to 2:00 a.m. during daylight saving time.
<br />
<br /> I regret to advise you the Board has concluded that good cause has not bee shown why
<br />its hours of sale and consumption regulation (Section 5) should be amended at this time
<br />to accomplish your Council's request. It is true that the Board has granted similar
<br />tensions for the cities of Virginia Beach and Norfolk buththose changes were made only bec
<br />of the substantial tourist and resort trade enjoyed by those localities. It does not ap-
<br />pear to the Board that your city may reasonably be classified as a tourist or resort area
<br />and, further, extension of the hours in your case cnuld ~et a prec~den~for fequ~st~ ~
<br />the same hours in many not dissimilar areas across the State contrary to the best interest
<br />of the public.
<br />
<br />I regret exceedingly I am unable to inform you more favorably at this time."

<br />Motion of Mr. Johnson and seconded by Mr. Smith, no be received as information.

<br /> Substitute motion of Mr. Holley and seconded by Mr. Smith, that the City Manager
<br />look into whatever forms of relief we can afford our business community who would cer-
<br />tainly be in a discriminatory position that they have to close an hour earlier than in
<br />competing communities, was adopted by the following vote:

<br /> 73-152 The following letter and petition received from Baron W. Cook, 1006 Cherokee
<br />Road, Apt. llG, was read:
<br />
<br /> "It is requested that the below-stated complaint be promptly directed to the proper
<br />authority in an attempt to resolve the problem as soon as possible.
<br />
<br /> Why must residents of multiple Portsmouth residential sections, specifically in-
<br />cluding the Hodges Manor Apartments situated on Cherokee Road, almost daily and constantl~
<br />often regardless of climatical conditions, be besieged, harrassed and plagued with con-
<br />tinuous, persistent, loud, nerve-shattering noises made by nonlicensed children riding
<br />mini-bikes, hondas, toyotas, etc. on the privately owned lots adjoining Hodges Manor area
<br />Multiple entrances and exits to this private property have been made by the "bike" riders
<br />which enable them to trespass and disturb taxpayers who are unfortunate enough to reside
<br />in close proximity to this property. Paths have been made from Portsmouth Boulevard,
<br />Elmhurst Lane, Hayson Street and City Park Avenue to enumeraze a few. Residents fail to
<br />comprehend why even the licensed riders are permitted to trespass on private property in
<br />residential areas. Auto drivers operatmng a vehicle with a gutted muffler are issued a
<br />ticket imposing a fine when they are detected and found guilty of this violation by a
<br />patrolman and they are also advised that the muffler must be replaced before it is lawful
<br />for them to again operate the vehicle.

<br /> Without a doubt, most parents of the "bike" riders are not aware of the fact that
<br />their child or children are trespassing, destroying privately-owned property, and dis-
<br />turbing the peace. Surely they would not wish to contend with such upon their property
<br />or that surrounding areas of neighbors and friends:
<br />
<br /> With oral Fermission of the property owners "No Trespassing'! signs were posted only
<br />to be promptly removed or destroyed. When approached, in person ~y a resident and also
<br />by two ministers of churches located on Portsmouth Boulevard and Cherokee Road, the
<br />children were uncooperative, belligerent, and even more inconsiderate by continuing to
<br />destroy and annoy regardless of the fact that a resident might be ill or must work even-
<br />ings thus requmrmng sleep and rest during the day or vice versa.
<br />
<br /> There exist designated places for the "riders" to ride, race, and enjoy their "bikes'
<br />without disturbing anyone. In all probability parents might have to drive their child or
<br />children and take their "bikes" to the allotted places, but that is not the responsibilit
<br />or problem of another.
<br />
<br /> Any ~dvice or suggestions pertaining to existing rules or laws or the introduction
<br />and passing of a new law which can and will be promptly enforced to eliminate the condi-
