This <br />authorizes the proper City officials to sign an agreement between the Seaboard Coast <br />Line Railroad Company, Jean M. Davis, and the City of Portsmouth pertaining to a railroad <br />crossing on McLean Street. <br /> <br /> This is an extension of McLean Street serving the new shopping center. Developers <br />of the shopping center are installing this crossing at their expense. The City is a <br />party to the agreement as it will be the City's responsibility to maintain the crossing <br />when it becomes a public street." <br /> <br /> On motion of Mr. Smith and seconded by Mr. Johnson, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT <br />WITH THE SEABOARD COAST LINE RAILROAD COMPANY AND JEAN M. DAVIS, AND <br />A SEPARATE AGREEMENT WITH THE SEABOARD COAST LINE RAILROAD COMPANY FOR <br />THE MAINTENANCE OF A STREET CROSSING WHERE McLEAN STREET INTERSFJCTS <br />AND CROSSES SAID RAILROAD. <br /> <br /> WHEREAS, it is necessary to provide and maintain a street crossing over the Seaboard <br />Coast Line Railroad Company tracks at a location as shown on a plat attached hereto; <br />and <br /> <br />WHEREAS, Jean M. Davis, by agreement has agreed to construct said crossing; and <br /> <br /> WHEREAS, it is necessary to enter into agreements with both the aforesaid parties <br />in order to insure future maintenance of said street crossing; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the form of the two agreements attached hereto which provide for the construction <br />and future maintenance of a street crossing as particularly described on a plat attached <br />hereto, are hereby approved. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager and the City Clerk are hereby authorize <br />and directed to execute said agreements in the name and on behalf of the City." <br /> <br />Ayes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 75-178 - "I submit the attached resolution and recommend its adoption. This authori <br />the proper City officials to sign an agreement between the Seaboard Coast Line Railroad <br />Company and the City for a railroad crossing. <br /> <br /> Alexander Street is being widened where a spur track of SCL crosses; therefore, <br />it is necessary to approve a new agreement for this crossing. This street is being <br />improved as part of the industrial access road being constructed from Victory Boulevard <br />to Elmhurst L~ne." <br /> <br /> On motion of Mr. J~hnson, and seconded by Mr. Smith, the following resolution was <br />adopte~ and by the following vote: <br /> <br /> "A RESOLUTION AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT ~ITH <br /> THE SEABOARD COAST LINE RAILROAD COMPANY FOR THE WIDENING, IMPRovEMENT <br /> AND MAINTENANCE OF A STREET CROSSING AT ALEXANDER STREET. <br /> <br /> ~EREAS,:it is necessary to provide a street crossing of the Seaboard Coast Line <br />Railroad Company railway tracks at a location as shown on a plat as attached hereto; <br />and <br /> <br /> ~{EREAS, it is necessary to enter into an agreement with the Seaboard Coast Line <br />Railroad Company with regard to the construction and maintenance of said street crossing <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia, <br />that the form of agreement between the City and the Seaboard Coast Line Railroad Company <br />dated April 6, 1975, by the provisions of which the Railroad Company grants to the <br />City an easement or right of way within the limits therein set out for the widening, <br />improvement and maintenance of a public road or street crossing (including the usual <br />appurtenances, such as a paved roadway, curbs, gutters, sidewalks, shoulders, slopes, <br />fills, cuts and drainage facilities) at grade across the right of way and track or <br />tracks of the Seaboard Coast Line Railroad Company at Alexander Street, Portsmouth~ <br />Virginia; and as particularly described in said agreement and is more fully shown on <br />the print attached to and made a part of said agreement as attached hereto be, and <br />the same hereby is approved. <br /> <br /> BE IT FURTHER RESOLVED that the City Manager and the City Clerk are hereby authorize, <br />and directed to execute said agreement in the name and on behalf of the City." <br /> <br />Apes: Early, Holley, Johnson, King, Smith, Wentz, Barnes <br />Nays: None <br /> <br /> 75-179 "It is the City's desire during the con~tructio~ of the new Churchland <br />Bridge that a new water line be hung on this structure.
