99 <br /> <br /> WHEREAS, Sophia Hornstein and the Estate of Nathan Cohen have made application <br />pursuant to Section 4-2 of the Zoning Ordinance of the City of Portsmouth, 1972, <br />for the granting of a use permit as hereinafter described; and <br /> <br /> WHEREAS, the applicants and the Planning Director have completed ali transactions <br />required to be accomplished in connection with said application, and the Planning Commis- <br />sion has recommended that such permit be granted. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> A. That the use for which the use permit hereinafter described is sought (1) <br />will not adversely affect the health or safety of persons residing or working in the <br />neighborhood of the proposed use, (2) that it will not be detrimental to the public <br />welfare, and ($) that it will be ~n accord with the purposes of said Zoning Ordinance. <br /> <br />subject <br />for the <br /> <br />That Sophia Hornstein and the Estate of Nathan Cohen be granted a use permit <br />to site plan restrictions, pursuant to Section 4~2 of the said Zoning Ordinance <br />operation of a sanitarium located on the property described as follows: <br /> <br /> Beginning on the north side of High Street approximately 65 feet <br />west of its intersection with Chestnut Street; thence west along High <br />Street approximately 50 feet to a side property line; thence north <br />along said tine approximately 100 feet to a point; thence east <br />approximately 50 feet to a side property line; thence south along <br />said line ipproximately 100 feet to the point of origin." <br /> <br />Ayeg:c Holley, Johnson, King, Smith, Wentz <br />Nays: None <br /> <br />73.~340 - The following letter from Director of Planning was read: <br /> <br /> "At its regular monthly meeting on 3 July 1973, the City Planning Commission con- <br />tinued its work related to Portsmouth participation in the National Flood Insurance <br />program which the City Manager assigned to the Office 6f City Planning as one of its <br />administrative responsibilities. The general p~blic was advised of contemplated action <br />in the legal ad which follows, and the Department of Law presented proposed City Code <br />amendments at the public hearing: <br /> <br /> FLOOD-INSURANCE: The City of Portsmouth entered into agreements with Federal <br />agencies to obtain certification of eligibility for preferential flood insurance to be <br />written by private firms handling insurance. While this certification has been in <br />effect since 1972, there are certain expectat±on of performance by the City of Portsmouth <br />to satisfy minimum Federal program standards. The Office of City Planning and the Office <br />of theCity Attorney are engaged in a research program to determine how the Housing Code, <br />Zoning Ordinance, SuRdivisions Regulations Code and the Building Code may be amended <br />to satisfy these minimum Federal requirements. During its May 1, 1973, public meeting, <br />the Planning Commission received several reports from the U.S. Army Corps of Engineers <br />relative to the Federal Flood insurance Program. The Planning Commission continued work <br />at its July 3rd public hearing meeting and received from the City Attorney a report on <br />city code amendments for continuation of the Flood Insurance Program. Prior to passing <br />along such recommendation to City Council, the Planning Commission, in open public <br />session, heard from interested citizens on these recommendations from the City Attorney <br />which it resolved to recommend "IN PRINCIPLE". The Commission suggests that City Council <br />may want to avail itself of a specially appointed "technical advisory committee" prior <br />to final action." <br /> <br /> Motion of Mr. Smith and seconded by Mr. Wentz, to be received as information, was <br />adopted by unanimous vote. <br /> <br />Motion of Mr. Smith and.seconded by Mr. <br />APPROVED <br /> <br />Vice Mayor <br /> <br />Johnson, <br /> <br />to adjourn at 8:15 p.m. <br /> City Clerk <br /> <br /> <br />
