<br /> WHEREAS, Sections 15.1-835 and 15.1-912 of the Code of Virginia, 1950, as amended,
<br /> provide for the amendment of the City Charter upon the holding of a public hearing
<br /> and th~ ~equest of the City Council to the General Assembly; and
<br />
<br /> WF~REAS, the City Council is of the opinion that certain amendments to the Charter
<br />of the City of Portsmouth are necessary and desirable at this time and has held the
<br />public hearing required by law to consider such amendments.
<br />
<br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia,
<br />that the City Attorney is hereby directed to prepare and transmit to the General Assembly
<br />together with certified copies of this resolution, drafts of bills amending the Charter
<br />of the City of Portsmouth, 1970, as follows:
<br />
<br />1. By repealing sections 9.02, 9.03, 9.04, 9.05, 9.06, 9.07 and 9.08.
<br />
<br /> 2. By adding section 2.14 thereto and by amending sections 2.06, 2.12, 3.02,
<br />3.03, 3.04, $.11, 5.02, 6.02, 6.05, 6.07, 8.02, 9.01, 10.08~ and 10.09 thereof, such
<br />new and amended sections to read as follows:
<br />
<br />Section 2.06. Eminent DOmain - Generally.
<br />
<br /> (a) The powers of eminent domain set forth in Title 1S.1, Chapter 1.1 of Title
<br />2S,3~ndnChapter 1 of Title 33~)~,Code of Virginia, 1950, as amended, and alt acts .
<br />a~e~d~t~y thereof and supplemental thereto, mutatis mutandis, are hereby conferred
<br />up~fi the:city of Portsmouth.
<br />
<br /> ~ ~, (b~ In any case in ~hich a petition for condemnation is filed by or on behalf
<br />of the city, a true copy of the ordinance or resolution duly adopted by the council~
<br />declaring the necessity for any taking or damaging of any property within or without
<br />the cit?,~ for the purposes of the city, shall be filed wi{h the petition and shall
<br />constitute sufficient evidence of the necessity of the exercise of the powers of eminent
<br />dOmain by the city.
<br />
<br />Section 2.12. Real Estate Assessments.
<br />
<br /> (a) All real estate within the city of Portsmouth shall be assessed for taxation
<br />in accordance with the provisions of the general laws of the Commonwealth except as
<br />hereafter provided in subsection (b) hereof.
<br />
<br /> (b) (1) In lieu of the method now prescribed by general law, the council shall
<br />provide for the annual assessment of real estate for taxation. To that end it shall
<br />appoint a single assessor of real estate to assess such real estate for taxation to
<br />serve at the pleasure of the council. It may preScribe the duties of such assessor,
<br />may require that he give his entire time to the duties of his office, may. fix his compen-
<br />sation, which Shall be payable out of the treasury of the city, and may provide for
<br />such technical and clerical assistance as may be necessary and advisable and for the
<br />payment of any other expenses that may be properly incident thereto. The annual assess~
<br />merits shall be completed by the assessor by the thirty-first day of January of the
<br />· ~?e~zin which they are made.
<br />
<br />~:~ ~g):~ The beginning of the tax year for the assessment of taxes on real estate
<br />shal5 bg July the first~ and the owner of real estate on that day shall be assessed
<br />for the taxes for the tax year beginning on that day. Ail Such real estate shall be
<br />assessed at its fair market value and the taxes for each year on such real estate shall
<br />be e~%~h~ed on the basis of the last assessment made prior to such year, subject to
<br />such changes as may have been lawfully made.
