Mabe <br />for a use permit to operate a hortisultural-cultivation facility on land zoned Residential <br />R-150 on the south side of Lewis Road west of its intersection with Mayflower Road. <br />Signed by Kemp C. Lefcoe, Attorney, spoke. <br /> <br /> On motion of Mr. Barnes and seconded by Mr. Wentz, the following resolution was <br />adopted, and by the following vote: <br /> <br />"A RESOLUTION GRANTING A USE PERMIT FOR THE OPERATION OF A SEWAGE PUMPING <br />SIATION NEAR PEACHTREE LANE AND GEORGIA DRIVE (UP-74-8). <br /> <br /> WHEREAS, Peachtree Associates has made application <br />the Code of the City of Portsmouth, Virginia, 1973, for <br />as hereinafter described; and <br /> <br />pursuant to Section 40-67 of <br />the granting of a use permit <br /> <br /> WHEREAS, the applicant and the Planning Director have accomplished all transactions <br />required to be completed in connection with said application; and <br /> <br /> WHEREAS, the Planning Commission has considered the application for such use permit <br />and recommended favorable disposition. <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia: <br /> <br /> A. That the Council expressly finds that the use for which the use permit herein <br />described is sought (1) will not adversely affect the health or safety of persons residing <br />or working in the neighborhood of the proposed use, (2) that it will not be detrimental <br />to the public welfare, and (3) that it will be in accord with the purposes of said <br />Zoning Ordinance. <br /> <br />40-67 of <br />property <br /> <br />That Peachtree Associates is hereby granted a use permit pursuant to Section <br />said City Code for the operation of a Sewage Pumping Station located on the <br />described as follows: <br /> <br /> Beginning at a point approximately 110 feet southwest from the southwest <br />corner of proposed Peachtree Lane and Georgia Drive; thence southwest along <br />Peachtree Lane 50 feet; thence north west approximately 53 feet; thence <br />northeast 50 feet; thence southeast approximately 53 feet to the point of <br />~rigin." <br /> <br />Ayes: Barnes, Early, Elliott, Oast, Wentz, Davis <br />Nays: None <br /> <br /> Zoning Petition Z 74-4C - Application by the Portsmouth City Planning Commission to az <br />correct error in the rezoning petition of March 21, 1974, filed by Mr. Roy D. Taylor and <br />~age M.
