365 <br /> <br />1974 <br /> <br /> NOW, THEREFORE, BE IT RESOLVED by the Council of the .City of Portsmouth, Virginia, <br />that Frank N. Bilisoly, R. C. Dempsey, Louis J. Leitner, James L. Choate and Joseph <br />C. Barber, be appointed viewers to view the hereinafter described portion of such street <br />and report to this Council in writing whether in their opinion, any, and if any, what <br />inconvenience would result from vacating and closing the following: <br /> <br /> All that certain piece or parcel of land, being a part of a 26 foot alley <br />sh~:wn on the Plat of Harry L. Alexander, which plat is of record in the <br />Clerk's Office of the Circuit Court of the City of Portsmouth, Virginia, in <br />Map Book 1, page 33, and being bounded and des'cribed as follows, to-wit: <br /> <br /> BEGINNING at a point 112 feet west of the southwest intersection of <br />Leckie Street (formerly Sale Street) and Peninsula Avenue (formerly <br />Wilson Avenue), as measured along the south line of Leckie Street, <br />and from thence running south along the west line of Lots 48, 49 and <br />50 on said plat and the east line of said 26 foot alley a~distance of <br />120 feet to a point; thence west and parallel with Leckie Street a distance <br />of 26 feet to a point; thence north along the east line of Lots 82, 83 and <br />84 on said plat and the west line of said 26 foot alley a distance of 120 <br />f~e¢;; to the south line of Leckie Street where it intersects With the west <br />line of said 26 foot alley; thence east along the south line of Leckie Street <br />extended a distance of 26 feet to the POINT OF BEGINNING." <br /> <br />Ayes: Early, Elliott, Holley, Oast, Wentz, Davis <br />Nays: None <br /> <br /> 74-374 - Motion of Mr. Wentz and seconded by Mr. Holley, the following resolution <br />was adopted, and by the following vote: <br /> <br />and <br /> <br /> ~'A RESOLUTION AUTHORIZING THE CITY MANAGER TO ADVERTISE AND RECEIVE BIDS <br /> FOR CERTAIN CITY-OWNED PROPERTY (LINCOLN STREET LOT). <br /> <br />WHEREAS, the City of Portsmouth presently owns a lot lbcated 9n~ Lincoln Street <br />said lot is more fully described as follows: ' <br /> <br /> All that certain lot of land lying and being in the City of Portsmouth, <br />Virginia, which is known as 432 Lincoln Street, being more particularly <br />described as Lot 21 on Tax Plate 21 as shown on the records of the Office <br />of the City Assessor of the City of Portsmouth, Virginia, having a depth <br />of approximately 120 feet and a width of 29 feet. <br /> <br /> WHEREAS, the said landis no longer needed by the City of Portsmouth and it is, <br />therefore, declared to be surplus property. <br /> <br /> NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Portsmouth, Virginia, <br />that the City Manager be, and he hereby is, authorized and directed to advertise and <br />receive bids for the hereinabove described property on such terms and subject to such <br />minimum bid restrictions as he may deem proper." <br /> <br /> Ayes: Earlyi Elliott, Holtey, Oast, Wentz, Davis <br /> Nays: None <br /> <br /> 74-375 - The following request to speak received from Alan E. Gollihue, 202 North <br />Stree,~, .Apt. 3, was read: <br /> <br /> "Permission is requested to speak at the City Council meeting on Tuesday, August 27, <br />1974~ Subject: Violation of the minimum!~housing code at property designated 350 Crawfor~ <br />Parkwa7 owned by Mr. B. W. Baker. Grounds for the request are that this matter has been <br />reported to city agencies over five months ago, with no results to date. Other grounds <br />are available upon request." <br /> <br />Mr. Gollihue spoke. <br /> <br /> Motion of Mr. Wentz and seconded by Mr. Oast, to be received as information and <br />that the City Manager furnish to Council a progress report at the first meeting in <br />October, 1974, was adopted by unanimous ~ote. <br /> <br /> 74-376 - The following request to speak received from George R. Walker, 1749 Spratle <br />Street, was read: <br /> <br /> "Subject: The Agenda of the 27 AMgust, 1974 Portsmouth City Council Meeting. <br /> <br /> Pursuant to Council Gag Rules 2z15.1 and 2-24 (1961 Code sections) it is requested <br />that my name be placed on the agenda of the subject meeting to address the failure of <br />Council to take corrective action to cause the administration to cease its violation of <br />sections of the City Code having to do with the Department of Public Safety. <br /> <br /> In the event that an amendment for such purpose has been drafted and placed on the <br />subject agenda the privilege of addressing such amendment prior to Council action thereon <br />is hereby claimed." <br /> <br />Mr. Walker spoke. <br /> <br /> Motion of Mr. Holley and seconded by Mr.~Early, that the City Attorney draft an <br />ordinance to make ~exp¼~cSti the status of the ~ublic Safety Department; copy of letter <br />submitted to Council by City Attorney be forwarded to Mr. Walker, was adopted by unanimom <br />vote.
