<br /> At a regular meeting of the City Council, held on February 25, 1975, there were present:

<br /> The Rev. Larry W. Schmidt, Pastor, Redeemer Lutheran Chnrch, opened the meeting with
<br />prayer, followed by the Pledge of Allegiance to the Flag.
<br />
<br /> Mayor Davis welcomed ali visitors in attendance.
<br />
<br /> The minutes of the Public Hearing meeting of February 10, 1975, and minutes of the
<br />regular meet~ing of February 11, 1975, to be approved as received, on motion of Mr. Wentz and
<br />seconded by Mr. Elliott, was adopted by unanimous vote.
<br />
<br /> 75-79 Public Hearing on consideration of resolution concerning Southeastern Water
<br />Authority of Virginia was held.
<br />
<br />Mr. George R. Walker, 1749 Spratley Street, spoke.
<br />
<br /> On motion of Mr. Early and seconded by Mr. Wentz, the £ollowing resolution was adopted,
<br />and by the following vote:
<br />
<br />"A RESOLUTION OF THE COUNCIL OF Tim CITY OF PORTSMOUTH, APPROVING THE ~MENDMENT
<br />OF THE ARTICLES OF INCORPORATION OF TH~ SOUTHEASTERN WATER AUTHORITY OF VIRGINIA
<br />SO AS TO CHANGE ITS NAME TO SOUTHEASTERN PUBLIC SERVICE AUTHORITY OF VIRGINIA,
<br />TO CHANGE THE LOCATION OF ITS PRINCIPAL OFFICE, AN~ TO EXPAND ITS PURPOSES TO
<br />INCLUDE A GARBAGE AND REFUSE COLLECTION AND DISPOSAL SYSTEM AND SETTING FORTH THE
<br />AR~ICLE~ O~AMENDMENT.

<br /> WHEREAS, the Cities of Chesapeake, Franklin, Norfolk, Portsmouth, Suffolk and Virginia
<br />Beach and the Counties of Isle of Wight and Southampton have heretofore created the Southeast
<br />ern Water Authority of Virginia, pursuant to the Virginia Water and Sewer Authorities Act
<br />(Chapter 28, Title 15.1, Code of Virginia, 1950, as amended) (the Act) to provide a water sys
<br />to serve the needs of the participating political subdivisions; and
<br />
<br /> WHEREAS, the aforesaid political subdivisions desire to amend the Articles of Incorporat
<br />of the Authority so as to change its name and the location of its principal office and to
<br />expand its purposes to include a garbage and refuse collection and disposal system;
<br />
<br />NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Portsmouth, Virginia:
<br />
<br /> Section 1. The Council of the City of Portsmouth, approves the amendment of the Articl~
<br />of Incorporation of the Southeastern Water Authority of Virginia so as to change its name,
<br />the location of its principal office, and the purpose for which it was created as set forth
<br />in the Articles of Amendment in Section 2 hereof.

<br /> Section 2. The Articles of Amendment of the Southeastern Water Authority of Virginia
<br />shall be as follows:

<br /> The Councils of the Cities of Chesapeake, Franklin, Norfolk, Portsmouth, Suffolk and
<br />Virginia Beach and the Boards of Supervisors of the Counties Of Isle of Wight and Southampton
<br />by concurrent resolution have adopted the following amendments to the Articles of Incorporati~
<br />of the Southeastern Water Authority of Virginia, pursuant to the Virginia Water and Sewer
<br />Authorities Act (Chapter 28, Titlm 15.1, Code of Virginia of 1950, as amended) (the Act),
<br />to,wit:

<br /> 1. The Article of Incorporation shall be amended by striking out section (a) and substi
<br />tuting the following:
<br />
<br />(a)
<br />
<br />The name of the Authority shall
<br />of Virginia" and the address of
<br />Virginia.

<br /> 2. The Articles of Incorporation shall be amended by striking out section (d) and subst~

<br />The purposes for which the Authority is to be formed are to acquire, finance,
<br />construct, operate and maintain a water system and a-garbage and trash
<br />collection and disposal system, all pursuant to the provisions of the Virginia
<br />Water and Sewer Authorities Act.
<br />
<br /> The Authority may contract with the incorporating political subdivisions, any sanitary
<br />district thereof or any authority therein created pursuant to the Act to furnish water servic
<br />and garbage and trash collection and disposal service upon such terms as the Authority shall
<br />determine; provided, however, that the same schedule of service rates shall be applicable
<br />to all such political subdivisions. The Authority is expressly prohibited from contracting
